    My first post, unedited. Shows that I called people on their attitude and the incorrect advice. I clarified his rights, said they should contact head office. If that failed then a letter before action. So maybe you could actually read the post rather than get all defensive, because it pointed out your error.

    People were unnecessary hostile to op when in fact saying all he could do is contact head office, or giving the impression he had no hope, his own fault, etc, were totally incorrect.

    So keep going, I'll check back in a bit to see how frustrated you're getting trying desperately not to admit it.

    I'll let you have the last word though as I'm nice like that. I've pointed out your glaring mistake, so other people don't follow that advice. So carry on the thread of you like.

    Sorry to hear about the problems you've been having with Tesco.

    Check out the section on this website regarding your consumer rights.

    You don't need a receipt. I think some people confuse your consumer statutory rights with situations where a customer changes their mind about a product e.g. they decide they don't like the colour of a jumper they've bought but there is nothing defective about the jumper. In that situation some retailers offer customers exchanges or gift tokens but this is offered in addition to your statutory rights and they can demand a receipt in this situation because they are basically doing the customer a favour.

    If a product is defective that is a different matter. You are protected under Acts of Parliament e.g. the Sale of Goods Act etc. You must show that the product is not of a satisfactory quality. It is implied in all contracts for sale of goods that the product will be of a satisfactory quality i.e. fit for purpose, free from defects and will last a reasonable time etc. You'll need to show that the product is not of a satisfactory quality.

    You don't need a receipt as this website at the above link confirms. You can instead prove that the product was purchased at Tesco by evidence provided by your mum confirming when and where the product was purchased, the Tesco sticker and the bank statement confirming when it was purchased.

    If you can show that the product is not of a satisfactory quality then you are entitled to a refund of the price you paid for it.

    I would write to Tesco's head offer as someone else has suggested. I would also make sure you keep a note of the names of the Tesco's employees you have complained to so far. This will show that you complained quickly to Tesco about the product i.e. you only received it for Christmas and it's already broken.

    If Tesco fail to offer you the full price you paid for it then you may need to consider making a small claim at Court. Before you do this, I would go to a Citizens Advice Bureau if I were you. They can help you with bringing a Court claim.

    That's about the only thing tink has got wrong, in this thread.

    However it USED to be the case, and the change wasn't all that long ago. (My mate bought a new TV not all that long before Comet folded, and the address request was still in force - at least on Comet's system anyway). Many people assume it IS still the case.

    Actually as the item is faulty. You don't need the receipt, a proof of purchase can easily be a credit card statement.

    I don't know why people are being so obtuse. People lose receipts. However as it's consumer rights they should be clarifying you don't need the receipt.

    As it's under 6 months and you have the card statement the law is in your side, TESCO are quite well know for trying this when the receipt has been lost. I've been in this situation before so have looked specifically for this problem, so I know how common it is.

    It's bad training in the stores. I wouldn't hesitate to contact head office. Head office quite often sort it out. If they don't a letter before action is in order.

    This is my first post for clarification. I only posted so much because people started questioning me on that post. Trying to muddy the water with ops rights with blame, opinion, hearsay and fake scenarios, not clarifying his actual consumer rights.

    I fails to see anything wrong with it. It was people not understanding how consumer law works, which dragged the thread on.

    Yes it used to be and was until recently so I stand corrected. See what I did there...if I am wrong I stand corrected.

    Quite funny though out of all the incorrect posts and there are many on this thread they pick up on mine. It's one thing I got wrong and it was responding to a fake scenario, "what if I did this post". Nothing at all to do with the original question. It's laughable really.

    Like I say op, or anyone who ends up in this scenario. You can feel free to ask me for advice as I've been here. Good luck :T
