Too rambling, incoherent and badly ordered. (Sorry, but you did ask for opinions).
PPCs don't really care about mitigating circumstances, and POPLA certainly don't. https://forums.moneysavingexpert.com/discussion/4879819 holds what most of us feel is an appropriate PPC appeal. There's nothing to stop you ADDING about what happened with your son, but it's not the focus of your PPC appeal.0 -
I think it will be fine as long as you expand this:

In every case where a motorist has raised the issue that your charges are not a genuine pre-estimate of loss, POPLA have accepted the appeal...
Because your version reads as though whenever anyone raises the issue of 'sorting a child's sickness out' they win at POPLA (in fact the opposite is true if someone only used that for POPLA they'd lose!).PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

if we are to believe you have "outed" yourself as driver, and wish to appeal to their "better nature" (if they had one, and if you amend it as the last 2 posts have suggested , then send it if you feel that is what you should do
maybe they have a heart , we just havent seen it yet unless there has been evidence of people paying lots of money onsite to the retailers (PE cancelled one because of that with a relative of mine)
excel refused to cancel one on the grounds of somebody being unwell so they got spanked at popla (I posted those 2 details on this forum already)
so if we assume they refuse your appeal , you get a popla code, then you draft a popla appeal up and get it checked on here before submission to popla
if you were to get any more parking charge invoices, this is what you send, possibly with additional DRIVER info , as registered keeper, admitting nothing at all

As the registered keeper of (reg) I'm in receipt of your parking invoice xxxxxx dated xxxxxx. I wish to invoke your appeals process as all liability to your company is denied on the following:
1) The amount being claimed is not a genuine pre-estimate of loss to your company or the landowner
2) Your signage does not comply with the BPA Code of Practice
3) You are not the landowner and do not have the capacity to offer contracts or to bring a claim for trespass
These points and others will be raised with POPLA should you not accept this appeal, and you will be expected to provide a full breakdown of your alleged loss, and your full unredacted contract with the landowner.
If you do reject the challenge and insist on taking the matter further I must inform you that I may claim my expenses from you. The expenses I may claim are not exhaustive but may include the cost of stamps, envelopes, travel expenses, legal fees, etc. By continuing to pursue me you agree to pay these costs when I prevail.
Any communication that does not either confirm cancellation or include a POPLA verification code shall be reported to the BPA as a breach of their Code of Practice - the BPA recently issued guidance to all members to remind them of this fact. Such communication may also be deemed harassment and pursued accordingly.0 -

HI Sarah - Oh dear what a mess this thead appears to have become.
Honestly - none of the regulars here would like to make a NEWBIE feel unwelcome and it is only by googling and finding out that these parking charges can be quashed that brings you to the site in the first place.
The truth is that there are only few regular contributors to this site and there are literally dozens of new cases each day plus having to keep up with all the others does take up a lot of time and effort.
Coupon mad is THE most dedicated and respected of all the regulars who spends literally hours every day to assist people like you. Both the newbie thread and successful complaints sticky threads have been compiled and adjusted by her to keep up with the current trends and that is in addition to all the individual help she gives daily.
Getting back to your situation though - when you emailed them -
did they respond and give a POPLA code?
If not you need to make another complaint along the lines:
Dear Parking Eye
Further to my previous email on ............ appealing the parking charge number..........., I note that you have failed to supply a POPLA code for the second stage of the appeals process.
As registered keeper, I deny all liability to pay this parking charge as it does not represent any genuine pre-estimate of loss either to Parking Eye or your client.
I would further like to point out that your signage does not comply with the BPA COP and that the driver on the day did not make a contract with you.
You are therefore invited to either cancel this parking charge now or supply a POPLA code to complete the appeals process as claimed on your Notice to Keeper. These points and others will be raised with POPLA should you not accept this appeal and you will be expected to provide a full breakdown of your alleged loss, and your full unredacted contract with the landowner. The latter will be necessary to demonstrate that you do in fact have the legal right to pursue these charges in your own name.
A valid POPLA code should be supplied by return to enable this appeal progress to the next stage as detailed in your notice and any failure to provide this will result in complaints to both the BPA and the DVLA; or alternatively cancel this parking charge now.
If you do reject the challenge and insist on taking the matter further by supplying a POPLA code (or not), then I must inform you that I may claim my expenses from you from this point onwards. The expenses I may claim are not exhaustive but may include the cost of stamps, envelopes, travel expenses, legal fees, etc. By continuing to pursue me you agree to pay these costs when I prevail.

Sarah - the reaction you got is pretty much the one I got when I posted. No one is being grumpy or out to get you - people here who are regulars deal with dozens (probably more) of these queries every day and they need the full info in a frank manner in order to help you. They've kindly offered help and you'd be wise to take it because they are really good at helping with these charges. I know how stressful it is to receive one but you just have to hang in there, do as is being suggested and with any luck you'll not have to pay it and can forget all about it. Good luck!0

THanks Chickadee, I'm taking all the "advice" i can and i am grateful for that. I never said i wasn't. i feel it's very easy to pick on people when it's anonymous. People can be whoever they want when their identity is safe.
I work as a retail and sales mgr in a small shop these days. I deal with the public daily, and have worked in customer relations for some 15 years in both the small outfit I'm in now, to a multinational clothing and Home company, when people have a question that may be obvious i would never treat them like they have some kind of mental deficiency for asking it. There are no stupid questions in this world, and the world would be a better place if we remembered how to be kind to one another.
we are not robots, we are not pre-programmed to know stuff, and not everyone's issue is the same as the next though the problem may stem from the same point.
Bullies shouldn't be tolerated in any situation, be it the school yard or in adulthood.0 -

Sarah - your comparison to your job is rather false - you get paid to do that. I've invested literally hundreds of hours on forum and off forum here to assist people as have all the regulars ( not sure what makes you a regular though ? ). In fact what I've done is minute compared to people like Coupon Mad, KIL and Daisy ( other than regularly get banned from various web sites which I think I might hold the record for ! ). For these reasons you shouldn't take a bit of snappyness too seriously - it's because some days, answering the same questions that have the same answers over and over again can get ..... well ..... tiring. This is even more frustrating when the Newbie thread ( kindly written by Coupon Mad ) contains 99.9% of answers to all situations - people just don't read things properly nowadays, they just want direct specific answers rather than putting in any thought to the process themselves - I blame Thatcher, computer games and global warming. This isn't aimed at you personally. Do you have children ? If you do just imagine the "Are we there yet ?" question a hundred times a day !!!!
