    Hi Elvisnobby,
Sorry to be blunt but yes you will be wasting your time especially regarding writing again with what happened on the day.

If they have given you a POPLA code you should draft an appeal BUT on the legal arguments you will find if you follow this link then read the NEWBIES thread especially post #3 for example POPLA appeals. For further help create your own thread ( click New Thread on the main page of the forum linked below)

    http://forums.moneysavingexpert.com/forumdisplay.php?f=163

Also use the POPLA checker you will find a link to in post #3 of NEWBIES to check the code for the deadline day - you only have 28 days from when the code was generated.

Its happened to me and parking eye have not allowed the appeal.. i am right again to them with further evidence of the appointment my little boy had in the hairdressers which i couldn't leave him and outlining the letter shown in the previous post... or am i wasting my time? should i now just go straight to POPLA?
Seeing as the clock is already ticking on your 28 day POPLA code, what do you think PE would do if you were naïve enough to write to them again? Most likely (because IMHO their agenda isn't parking management, it's extracting MONEY from other real businesses' paying customers - like a parasite) they would drag their feet and reply after your POPLA code had timed out and then they'd sue you.

BTW you WILL LOSE at POPLA if you write about appointments at the hairdresser. Then Parking Eye will sue you.

So to avoid that, take CC's advice and look at how to win at POPLA, the legal arguments to include like 'no GPEOL' and no authority. ParkingEye are not the most compassionate of companies but you can avoid them suing you.

A friend received one this morning being 12 minutes over a free 30 minute period.
sadly he panicked and paid it straight away.

Any recourse now, or as paying it admitted guilt?

    Guilt?

If he'd paid £100 to a Nigerian 419 scammer, would you be using the word 'guilt'? How would he be 'guilty' in that context? What's the difference? (Hint - there is none!).
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Well, yes. We are aware that they are basically criminals, but how do we go about disputing it now?

the invoice is now paid, so all you can do is try that challengethefine site or try the small claims court, as its a civil matter

I am thinking of letting him go down the route of disputing the payment with the bank, see if they can reverse it in some way?

Janette, you do not want to use a TWO (NEARLY THREE) YEAR OLD POPLA appeal from Spring 2014! It would lose.

Read the NEWBIES FAQS thread, my signature below tell you where to click. Winning POPLA appeals look different than they did in 2014.
