    So does almost everyone here, but the POPLA appeal isn't about the overstay. See the Newbies thread near the top for a link called 'How to win at POPLA'.

  • I have had a reply from Parking Eye....a very long legally worded reply.
    The upshot of it as far as I can tell is that - the law of pre-estimate of loss has been changed so they can charge such a high amount due to
    a - there is a strong commercial justification for the charge
    b - there is ample case law to suggest that the value of such a parking charge is not punitive
    c - Parking Eye can still provide evidence that this charge is a genuine pre-estimate of loss.

    They also state that they need to know who was the driver of the vehicle at the time and if I dont provide a name then I am liable anyway.

    What do I do from here?

    I appreciate any help and advice you can give me

    you are not required to name the driver under POFA 2012

    Same advice as I gave this person on pepipoo (my post #16 as SRM) just send a response online as it's free and you know it is received:

    Also report them to the BPA for the breach of the CoP in pretending you have to name the driver to get a POPLA code (lies). Use the email addy for Steve Clark which is in the 'NEWBIES Read this first!' FAQs sticky thread here at the top of this forum.

  • Thank you for the advice...I have submitted an appeal online.
    Hope that will be the end of the matter.....

    It won't be the end of the matter! POPLA next so I would have thought you'd have been doing what most Newbies do, and planning your POPLA wording. NEWBIES thread post #3 has a link 'How to win at POPLA' (when you say 'I have submitted an appeal online' I hope you don't mean you actually DID get a POPLA code but didn't use a forum example winning POPLA appeal)? You did find the 'magic words' for beating PE at POPLA didn't you?!

    Hi,
    Thanks to everyone here who helped me I just had a reply from POPLA and my appeal was allowed so saved me £100.
    I think this forum is a godsend for people who aren't sure of how things like this work so thanks again!

  • Its happened to me and parking eye have not allowed the appeal.. i am right again to them with further evidence of the appointment my little boy had in the hairdressers which i couldn't leave him and outlining the letter shown in the previous post... or am i wasting my time? should i now just go straight to POPLA?
