Hi,
Could somebody please help me out....
I have received a Parking Charge Notice from Parking Eye for overstaying the free hour by 12 minutes the week leading up to Christmas.
The charge is £100 reduced to £60 of its paid within 28 days.
This seems harsh and also unfair for the 12 minutes bearing in mind how busy the shops are in Xmas week.
Do I have to pay it or is there some way to have it retracted?
I have tried reading through threads but it got very confusing.
Thanks in advance for any help

have you read the NEWBIES - READ THIS FIRST sticky thread at the top of the forum ? about the 4th one down ? if not , why not ?
if yes , what have you decided is the best course of action now ?0 -
Do you have receipts (or bank/cc statements) showing you shopped at the retail park on that day?
Despite being the most rapacious PPC, they do react positively (personal experience) to submitted copies of receipts or (redacted) statements as per above. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

''Do I have to pay it or is there some way to have it retracted?''
Why not just read the sticky threads here where all this is covered...? Kind of surprised at all the new threads this week where no-one has read these...sigh:

Hi again,
I have cobbled this letter together to send to Parking Eye.
Do you think it will do the trick?

To whom it may concern
Please accept his email as an appeal against PCN ref in the subject line above. There are various reasons why I am appealing against this PCN:
1) I was a paying customer when I parked at the retail park on that day
2) The fine is outrageously high and totally out of proportion
3) The 12 minutes I was over was time taken to enter the car park, find a space, park the car, then return to the car, leave my space and exit the car park. On Saturday 21st December, the last Saturday before Christmas, surely the busiest shopping day of the year and as such one where a reasonable amount of ‘grace time’ to enter and exit the car park is the minimum expected by customers.

I am sure you can see that I am correct in challenging this charge and as such expect to have it quashed.
0 -
it should be more like this (not I DID THIS , I DID THAT etc ) :-Dear Parking Eye,
As the registered keeper of (reg) I'm in receipt of your parking invoice xxxxxx dated xxxxxx. I wish to invoke your appeals process as all liability to your company is denied on the following:
1) The amount being claimed is not a genuine pre-estimate of loss to your company or the landowner
2) Your signage does not comply with the BPA Code of Practice
3) You are not the landowner and do not have the capacity to offer contracts or to bring a claim for trespass
4) The driver was a paying customer when they parked at the retail park on that day
5) The 12 minutes they were over was actually time taken to enter the car park, find a space, park the car, then return to the car, leave the space and exit the car park. On Saturday 21st December, the last Saturday before Christmas, surely the busiest shopping day of the year and as such one where a more reasonable amount of ‘grace time’ to enter and exit the car park is the minimum expected by customers as per the BPA code of practice.

These points and others will be raised with Popla should you not accept this appeal, and you will be expected to provide a full breakdown of your alleged loss, and your full unredacted contract with the landowner.
If you do reject the challenge and insist upon taking the matter further I must inform you that I may claim my expenses from you. The expenses I may claim are not exhaustive but may include the cost of stamps, envelopes, travel expenses, legal fees, etc. By continuing to pursue me you agree to pay these costs when I prevail.
Please issue your cancellation within 35 days of this letter, or forward a popla verification code.

Thanks very much for your help. Hope it works.0

if it doesnt you will win at popla with a similarly worded but much better appeal culled from the usual successful appeals linked in the newbies thread
as for the draft I posted, its one by stroma that includes the key points of appeal, but I added and edited 2 of your points into it so that the driver was not identified at this stage (you are appealing as RK for now, not as the driver)
you cannot win just because something is outrageous, but you can easily win (and many people do) on making them prove that the charge is a genuine pre-estimate of loss (which it isnt)0 -
The 1st hour is free there, did you pay for the extra hour as well0
-
No, I was just there trying to use the first free hour but I went over by just a few minutes.0
