Parking fine paid but i want to appeal....Help!!

Options
Hi all,
I have been reading about this kind of problem in the forum but am a little confused on what i can do with my situtation.
I have received a parking charge notice from the Moorgate retail park, Bury. £100 (£60 if paid within 14 days)
I arrived at the retail park and returned to my vehicle well within the 2 hour restriction. I then (as i thought) left the retail park and went over to KFC with my daughter for something to eat.
If anybody is aware of this car park you will know that the KFC is on the opposite side to the retail park, separated by what looks like a road. Because i went to KFC i have gone over my time.

The letter for the parking charge notice shows my vehicle entering and then leaving via the traffic lights. I assumed the max 2 hr stay applied to the car parking spaces and i thought KFC was its own property.

The problem i now have is i paid the £60 fine for fear of getting charged the max of £100 then appealed via email but i have read i can not appeal if i have paid as i admit liability.
I was a KFC customer and i thought as an after thought most car parks give you 3 hrs if you are a customer? i paid by card so can prove it.

Could anybody explain what i can do about it or if i have blown an appeal as i have already paid the fine?

Anyone who can make it clearer for me would be greatly appreciated.
Thanks

  • You came here too late.
Sorry about the £60 but its gone, it was not a fine, it was an invoice dressed to look like one and we could have helped not pay it very easily.
    Better luck next time.

To late now and trying to recover funds will be long winded and require the intervention of the small claims court. Write this one off to experience and spend your time wisely reading and researching on these forums.

Pretty much blown any chance of immediate recovery and you're going to have to put this down to experience. You could, as a customer at the time, badger the retailer/KFC to see if they will cover the charge, but I'd put your chances well South of none!

But I'd write a letter of complaint to tell them that you, your family and relatives will never set foot over their doorsteps again, nor will as many of your friends you can persuade to follow your example.

At national level Michael Green of 'Challenge the Fine' is garnering support to take up a High Court case to recover charges paid to PPCs - get yourself registered there.

Although I think Michael is struggling to get the requisite numbers of people to sign up.

Should have appealed without paying, should have looked it up earlier, you've been scammed. This was never a real fine; easy to appeal if you know how. Now your only recourse is small claims or to register your details on Challenge the Fine (see the link above) please do register with Michael Green as he needs numbers to be able to take action!

NEVER panic and pay a parking charge - in most cases, I would say don't even just pay a real one from the Council - you appeal. OMG. Council ones are almost all won if you go to pepipoo.com forum - and as for private ones like this one, they are so easy to get cancelled by following our advice on this forum.

Two hours is not long enough to have a meal, have a child seat fitted, choose a carpet, and hunt for bargains in Home Bargains, how can anyone think that it is? Anyway here is a way to get them to waste that money.

Go and get another one in exactly the same circumstances and do not pay it, send the company a rubbish appeal to get a Popla code. Appeal it using one of the pro-forma statements on here. and cost them £40 odd quid. Repeat as often as necessary.

If they are no longer with the BPA come back to us and we will see if we can get them in hot water over v.a.t.

You can send them a Letter Before Claim asking for the money back on the basis that it wasn't a valid charge, and then take them to small claims court over it. Expect quite an uphill struggle though.

His sign-up rate is now over 500 per day and increasing. He could reach his 100,000 in a few months. Of course, Beavis may have changed the landscape dramatically by then.

  • Thank you all for that. I'm gutted i paid in haste now. I just panicked as this is a lease vehicle and the "charge" invoice had already been to our finance company before coming to me, i panicked over the max fee. Next time i will question first. Thanks again everyone who took the time to reply

Let us know what happens in the end if you just register on Michael Green's website - you could get a refund in the end, in theory, and he's genuine (some of my colleagues at a certain PPC appeals firm which will remain nameless in my posts, have spoken to him).
