Incorrect sofa delivered....

Hi,
I ordered a natuzzi leather corner sofa from BHS Home over 10 weeks ago, yesterday the sofa arrived but instead of sending a one seater for the corner they sent a 3 seater. I accepted delivery of the two correct pieces but I refused delivery of the 3 piece (basically it wouldn't fit in the door!). I have checked all my paperwork from BHS and I have ordered the correct items, so I rang BHS customer services but the manufacture is closed until Monday so they can't do anything. However they did say they would get it sorted for me.
What are my rights here, the other part missing will probably take another 10 weeks to arrive and whether there is a batch colour issue I don't know! Am I entitled to anything in way of compensation from either the manufacture or Bhs for the inconvenience?
Any help would be appreciated.
Thanks

Not really until you've given them a chance . . .Am I entitled to anything in way of compensation
They may have your missing item. Maybe there's another customer somewhere fuming that they tried to deliver a "one seater" when they'd ordered a 3 seater . .:)
If it takes 10 weeks and the colour is different . . well, that's something else0 -
What If...
What if it just got loaded onto the wrong van and can be delivered in a few days?Censorship Reigns Supreme in Troll City...0 -
Thank you for your help.
I really hope it is as easy resolved as the wrong piece just delivered.
However, as BHS will be calling me on Monday to give me an update I would like to be clued up on what I should accept if they go down the road of having to order another piece and waiting for that.
Can I just say, I would much rather have the correct sofa in my living room now without any inconvenience but this isn't the case

When ever a breach of contract occurs, the party not in breach is entitled to recover any direct losses they reasonably suffer as a result of the breach. However, you do have a statutory duty to try and mitigate your loss.
Theres no entitlement for inconvenience however that doesn't stop you trying to negotiate a goodwill gesture from the retailer.
You may have some entitlement if you incur actual costs but its too early to tell if that's the case just now.You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride0 -
Just an update folks,
BHS called this morning, The incorrect sofa was made so another order of the correct piece is being made, but due to colour match they are making a replacement sofa. This will take 10 weeks:(
They have offered me a goodwill gesture of £75 BHS gift card.
After spending thousands in store already there is nothing more I need in store and I thought £75 wasn't a very good offer.
Does anyone have any thoughts?
They are due to ring tomorrow to confirm reordering.
Any help would be appreciated.

what is it you want, compensation for...
did anyone have an accident, loose a limb, loose their job...
no someone screwed up, it happens, but you will be more than happy to demand as much monetary value.
did you check whilst it was all on the van?
why didn't you reject the whole lot as that is not what you ordered?
what real inconvenience will it be
cancel the order get the money back on the credit card and vote with your feet, take the goodwill gesture and buy someone a present, donate to a charity..0 -

So sorry I asked here for advice. I will not bother again.
Just as a matter of interest, would you be happy for your family having no sofa to sit on for 10 weeks? So that's why I only refused deliver of the wrong part!0 -
why would you have no sofa to sit on for 10 weeks,
you wouldn't of got rid of your sofa before checking you new one :-
A) arrived
was the right one
would you?
its not about asking for advice you stormed on saying i want compensation, but you have not stated what for?
I have MS, i fell over today, should i claim compensation from my legs for not being fit for purpose?
life is not all about how much money can i claim for every miniscule !!!! up made in life0 -
My advice is ask for a refund and get a sofa with a shorter lead time OR wait it out and end up with the sofa you originally wanted.
You might get a loan sofa from them for the 10 weeks instead of the £75 voucher if you ask but I'm not sure if they'll have any. Could solve your problem of nowhere to sit though!Hi. Unless they have been and taken these two correct pieces away, the op (and family) apparently do have somewhere to sit whilst awaiting the new suite . . .. I accepted delivery of the two correct pieces
plus £75 compunsayshun . . . . . for all the trauma and suffering0
