    Dear ,

    As the registered keeper of (reg) I'm in receipt of your parking invoice xxxxxx dated xxxxxx. I wish to invoke your appeals process as all liability to you company is denied on the following:

    1) this charge is not a genuine pre-estimate of loss
    2) your signage does not comply with the BPA Code of Practice
    3) you do not have the authority or permission to issue invoices at this location

    These points and others will be raised with Popla should you not accept this appeal, and you will be expected to provide a full breakdown of of your alleged loss, and your full unredacted contract with the landowner.

    If you do reject the challenge and insist upon taking the matter further I must inform you that I may claim my expenses from you. The expenses I may claim are not exhaustive but may include the cost of stamps, envelopes, travel expenses, legal fees, etc. By continuing to pursue me you agree to pay these costs when I prevail.

    Please issue your cancellation within 35 days of this letter or supply a popla code to appeal to them.

    you appear to have 2 PPC`s listed in post #21, so I suggest you amend the incorrect one if I am right, otherwise it seems similar to the stroma letter and has the main 3 points listed (contract, signage and not a gpeol)

    I would suggest either can be used once edited
  • I am sorry to keep going on, but obviously want a letter as strong as possible to try and get this thing closed.

    you havent even edited post #21 yet , lol !! (look for a ppc called P.E. which should actually be P.D.) ,clearly a casualty of the copy and paste philosophy (same error in post #15 too)

    yet some people believe the following would suffice
    cancel or POPLA code please !
    I feel that pepipoo one is too long and that the PPC is more likely to give you a popla code than cancel the whole charge (unless you have very real and valid mitigating circumstances that is)

    personally I would go with post #22 myself, but thats me

    I know the Pepipoo letter was very long but apparently the PPC cancelled the charge without it even going to POPLA, so wandered it it would work for me too

    the only way you can know for sure is if you try it

    if not, you will get a popla code , same as the other replies will generate

    Hi, I received a Parking Charge Notice whilst unloading a Christmas tree into a friends flat in December. I did not respond to the windscreen ticket and waited for the NTK. I appealed to the PPC who rejected it and now have my POPLA code.

    I have uploaded the rejection letter, please have a look to see if there is anything I could use for my POPLA appeal.

    Here is an outline of the letter I sent to the PPC:

    Following legal advice, I wish to challenge this PCN.

    My challenge is partly based on the assertion that your parking charge does not represent a genuine pre-estimate of loss to yourself or the landowner and that you do not have sufficient interest in the land to issue contracts. In every case where a motorist has raised this issue against you, POPLA have accepted the appeal. You are therefore fully aware that there is no prospect of your charge being upheld.

    If you do reject the challenge and insist upon taking the matter further I must inform you that I will claim my expenses from you. The expenses I will claim are not exhaustive but may include the cost of stamps, envelopes, travel expenses, legal fees, etc. By continuing to pursue me you agree to pay these costs when I prevail.

    1. Your claim is not a genuine pre-estimate of loss.

    2. I believe your company does not have sufficient interest in the car park to issue contracts to anyone.
    (BPA CoP Section 7, a landowner contract must specifically allow Park Direct to pursue charges in your own name in the courts and grant you the right to form contracts with drivers. I require Park Direct to produce a copy of the contract with the landowner as I believe it is not compliant with the CoP and without it, Park Direct have no legal standing nor authority at this site which could impact on visiting drivers.)

    3. Your signage does not comply with the BPA Code of Practice.

    If you reject this appeal, I require within 35 days a POPLA verification code for me to appeal independently as per the requirements set out on the POPLA web site, further supported by the BPA Code of Practice.

    Any help conjuring up a POPLA letter would be greatly appreciated, I do not want to say the wrong thing nor do I want to say too little.

    you seem to have done well so far, so why not use the links in this thread https://forums.moneysavingexpert.com/discussion/4816822 and draft up an appeal in notepad you think is suitable and post it here for checking ?

    that is what others do and are asked to do
