If you emailed PP over the Xmas or new Year break it's hardly surprising you got no reply. Why not ask again?

  • Hi,
As promised......I have finally heard from the Approved Operator Scheme (BPA).
They said that although they cannot become involved with disputes
between myself and the car park operator (which I realize), they will be happy to make contact with the operator concerned to seek to determine whether they are non-compliant of our Code, as this operator is a member of the BPA.
    And I quote:
"If a member is found to be non-compliant of the Code, they would be subject to our Sanctions Scheme, where Operators who are non-compliant the Code can expect to receive a number of penalty points depending on the severity of the offence. As with driving offences, once an operator’s ‘licence’ has reached twelve points in any given 12-month period, then they are likely to be faced with suspension or expulsion."

I do hope they can stop them causing more people grief.....

Rossendales Collect are clearly ignoring the letter I sent them as I have received a further letter today titled:
    'POTENTIAL FIELD VISIT'
    in large red capitals!
They are now saying that they are 'passing my file to one of their debt collectors who may visit my home within the next few days to obtain payment etc'
They end by saying that my account will not be overlooked and that they intend to obtain full payment!
    Nice people....

I know that they cannot come to my house but these people are annoying the hell out of me!
    Should I continue to ignore?
Many thanks again for all your valuable advice to date.
If it weren't for you all, I probably would have caved in by now.

A good plan - leave them alone to do their 'field trip'!

  • Hi all,
I have just received a further email from the BPA investigating team. In it they thank me for the copies of parking charges I sent and they say that they are going to contact VCS regarding the fact that Rossendales are pursuing me on behalf of Excel Parking Services Ltd.

    Which I welcome!

However they want me to contact the airport in question and ask whether the Airport Bye-Laws are in place in the area where my parking charge notice was issued. Once I have obtained this information and if the parking charge notice has been issued incorrectly (under POFA when the By-Laws apply) they will investigate further.

Does anyone know if the Airport Bye-Laws are definitely in place on this stretch of road?
I remember reading that they were?

    Many thanks in advance

  • Thankyou Redx,
I suppose I will have to contact airport formally to comply with BPA investigating team wishes.
  • Ah just when I thought they had gone away...I wish!

Clearly, the investigative team for the BPVS have done what they stated and had a word with Excel.
I haven't heard anything for several weeks now from Rossendales but yesterday I received a new demand from them but this time their 'client' is VCS Ltd.

It looks like they are starting the paper chain all over again from VCS but have increased their 'fee' to £72!

    I shall continue to ignore.........
    Yes?

Yes ignore the trash (but not any real 'Letter before Claim' from VCS or court papers). And I wouldn't waste my time finding out about the damn bylaws either, why should you as an ordinary member of the public being intimidated over this groundless charge. It's for VCS to prove their sily 'case' (which they cannot); it is not for you to have to do anything! Unless you have to put a defence together one day, like those rare 'lucky'(!) people like Mr & Mrs Ibbotson who got to see VCS try & fail to sue them in Court. The Ibbotson case is funny and VCS don't try court much at all!

@OP. Have you contacted the JLA yet? It strikes me that any investigative team worthy of the name would be sourcing its own evidence not seeking to rely on an interested party (you - as the complainant). There is nothing to stop them making a request for proof from JLA in just the same way as we could.

If you are interested a copy of the byelaws is available on this link.
My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

For those seeking more detailed advice and guidance regarding small claims cases arising from private parking issues I recommend that you visit the Private Parking forum on PePiPoo.com
