    posts #13 and #14 also listed Credit Services Association and parking prankster on your TO DO list , no mention of either in the above

    as for DR, they cannot take you to court, only the landowner or their legally appointed agents can do that

    so as per the first few replies in this thread, READ the NEWBIES sticky thread (4th one down) as that fully explains what to do and why, including mentioning debt collectors etc

    there was no need to google , all you had to do was read the NEWBIES thread and previous replies in this thread, like I did ;)

    Sorry but i forgot to contact the Credit Services...sadly overlooked but mainly due to getting caught up with stuff to do for Christmas.

    I had 'googled' debt collectors prior to joining the MSE Forum.

    That's all good. The CSA will investigate DRP and the BPA are already investigating the VCS/Excel shenanigans. Let us know what the BPA say because sometimes their responses are useful and other times they need another prod to look at it properly.

    Ultimately you either want the charge cancelled or be allowed to appeal as KEEPER (not naming the driver to anyone) and then get a nice POPLA code of course. We win 100% of POPLA appeals so that would be as easy as cancellation.

    I am in exactly the same boat as you and have the vcs excell and Rossendales letters! Mine is dated 30/12/13! I am yet to do anything but will be reading the newbie sticky this weekend to start the process! Please update with any info! Would you advise emailing or letters, also is it worth contacting the ombudsman and dvla given what you have said re responses.

    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

  • Hi, I have now done all that you suggested and also sent the debt collectors (Rossendales) a letter.

    Today I have received yet another letter despite this now saying that they will 'recommend to our client that:
    ....A doorstep collector being instructed to visit your property to collect payment.
    Or
    ....A commencement of legal proceedings' etc.
    I have also prompted the BPA to see what is happening their end.
    I really thought the letter might keep them off my back for a while?

    They won't send the boys round (and if anyone from there darkens your doorstep, you are totally in your rights to tell them to FRO. If they won't/don't, call the BiB).

    The 'legal proceedings' paragraph is not qualified by words like 'may' or 'recommend' for no reason. They cannot institute legal proceedings, only the creditor or their legal representative can do so.

  • All debt collectors need a licence to operate. The OFT are responsible for this licence but as from the 1st April 2014, the FCA takes over.

    All debt collectors as from September 2013 needed to apply for an interim licence to operate (from FCA) and as all current OFT licences expire on 31st March 2014. Debt collectors then have a few months grace to apply for another full licence.

    So you could make both a formal complaint to both the OFT and FCA:

    stating that you've denied all libaility for the debt (which also supplies the wrong creditor) and that you've requested that they refer it back to their cleint and that they are still pursuing you and threatening doorstep visits.

    Do also make another attempt to contact PP - he is aware of this thread - as I sent him the link in a pm - so he will be waiting for you to supply the details.
