parking eye charge in bathgate scotland

my ex partner has informed everyone but me that I have a £135 park fine for b&m Bathgate west Lothian in Scotland ive never received a fine & how do I go about finding out if I do have one ? I don't even know were b&m is & on 20 august 2013 my ex partner who I was out with at time had my car as I was in job centre so has b&m seen him go into store with my kids ? I cant deal with this stress can anyone help thanks

    If you're the Registered Keeper of the car, then any parking charge (especially from an ANPR camera outfit like PE) will have been addressed to you at the address you have provided to the DVLA in your car registration documents.

    However, in Scotland (unlike E & W) the liability for paying a PPC cannot be passed to the RK. So only the driver can be pursued. If you weren't the driver, then PE must chase the driver, and if they don't know who the driver was then they can't pursue anyone. You are under NO obligation to tell them who the driver was.

    How does your ex know you have this charge and you don't?

    In Scotland, if the driver hasn't been identified, you can safely ignore this. You will probably receive a blizzard of letters from PE and debt collectors, but all can be ignored.

    Come back at any stage for reassurance if you get overly concerned.

    If you weren't driving it's not your problem. If you are getting stressed and want no more to do with it you could write to them informing them who was driving.

    If so you should receive a letter in the post about it. Just tell the parking company the details of your ex so he can deal with it.

    That is an option but some people do get stressed by ignoring things. Her call I guess.
  • I am the registered keeper & my v5 is registered to my old address in York ! people living there have given my post to nobody but me! I did live in Scotland for 2 wks but my ex abused me & my kids & left 23 august 2013 I was at that time in Scotland on 20 august I was in job centre & my ex lives in Bathgate Scotland & he took my kids into b&m he knows Bathgate really well as he lived in those place since he was born & knows u can stay there for 2 hrs! he seems to have received other bus lane charges from York but 2 are legimate but never got notifications from them either ! so why he got my post ! & is this park eye ticket been submitted if I contact them it gives them chance to charge ! some people on a site are saying that they are getting a small claims court charge so does this happen ! ignoring any letters that's if I get any more what do I do?

    It makes no difference, if the parking event happened in Scotland then there is no legal reason to name the driver, even if they live in England. Popla is out of jurisdiction , Pofa2012 doesn't apply to events not within its area. And the small claims is unlikely to hear claims when there is no certainty who the driver is, and for a breach of contract in a place they don't cover
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    Have you had any formal notice from the parking company of the "charge"?

    Not that it matters as the advice is to ignore it
