Draft Rejection letter to UKPC - thoughts ?

AoD – thanks. My husband doesn’t see any issue in admitting he was the driver.
I appreciate this will be an alien concept to some posters but being from an older generation the concept of trying to trip people up is not in our DNA ! We just want to challenge this unjust charge and get it out of the way a.s.a.p.
Kirbyinfurnesslad – thanks to you too. Yes, we do realise that if/when they reject the appeal we would then have to go to Popla and thanks for suggesting we come back here again for help with the Popla appeal. I think the problem is that the process isn’t complicate but it’s made complicated by everyone who ‘knows’ their advice is right despite it being conflicting !
We’ve taken screen prints of the photographic evidence from the UKPC website just in case they lose
it as it clearly shows the space next to our car is not big enough for another car. What else might they have in their ‘evidence’ pack ?
For what it’s worth, his nervous reflux has already started up again.
I can understand where you are coming from on this point, but thats a problem with any open forums.
Your Popla appeal needs to only be based on two legal points to win, the appeal isnt based on anything that happened on the day (known as mitigation), so your photos are completely irrelevent, popla does not take in to account any mitigation.
So get your code and post on this thread, have a look on the popla decision thread on here
Happy to help you but i do think you need to realise this is nothing to worry about, it is not a fine, or anything illegal, Oh and UKPC dont do courtProud to be a member of the Anti Enforcement Hobbyist Gang.:D:T0 -
BrightonandHove – after being so helpful up until now why do you now have to resort to insults ?
I don’t know how old you are and don’t really care but suggest you have some respect for people who may not be as mentally robust as you. I’m glad he‘s unlikely to log on to this forum and see such an insensitive post. He is not lazy but you have been extremely rude.
Apologies if that came across rudely. It get's extremely frustrating repeating advice that has already been given very clearly by a number of posters. Once again, apologies if you were offended.0 -
But it is a game, and if you adopt a certain strategy, (the short game)you will win in in very short order. If you play the long game, you will, statistically, also win, but are you sufficiently fit to last the course.
Send in an appeal, saying whatever you like, perhaps that you did not have your Weetabix, and could not see the signs properly, get the Popla code and hit them with contract, slgnage, and GPEOL.You never know how far you can go until you go too far.0 -
BrightonandHove – thank you for your apology. Telling someone to ‘grow a pair’ doesn’t just ‘come across’ as rude, it is rude.
It may be frustrating repeating advice which you think is a) correct, b) clear and c) has been repeated by others but you have to understand, from my point of view, I have to sift through conflicting advice to try to understand which is correct. Just because ten people say the same thing doesn’t make it correct.
It is also extremely frustrating when asking questions to just be told what to do and not why. I appreciate all the help everyone has given but I have to understand some of the whys and the consequences of not complying with all of the advice. I now understand that appealing immediately rather than waiting until we get the NtK isn’t actually wrong but does allow UKPC to have the details of the driver sooner rather than later. We have to be allowed to take that decision and course of action if it shortens the process and feels more comfortable to us.
All – including The Deep.
Whatever you may think, this is not a game. This is an unjust charge which has upset my husband (and me) and whilst we want to win our case we want to do so in an honourable way, even if the PPC may not be acting honourably. To act in any other way would upset us even more. You may think this is stupid, wet, whatever but it's the way we operate. Please respect that.0 -
. I now understand that appealing immediately rather than waiting until we get the NtK isn’t actually wrong but does allow UKPC to have the details of the driver sooner rather than later.
UKPC never actually have to know who the driver is. That's how the Protection of Freedoms Act works - if they don't know then they have extra "rules" they have to follow. If they don't adhere to these extra rules then the "ticket" becomes even more invalid and easy for POPLA to cancel ( if something can become more invalid ? ).
Appealing now may shorten the process but it's not guaranteed. As you say - it's your choice. The risks and proposed way forward have been laid out to you - now it's over to you.0 -
Thanks BrightonandHove. I understand why to write in the third person but why wait for the notice to keeper ?
It is in the ''newbies read this first'' sticky thread at the top. That's why some posters got a bit rude because it's already all covered in the info threads at the top. As is 'how to complain to the retailer' & get it cancelled when it's a retail car park...(also possible in any landowner car park, but retail ones particularly).
We do get jaded, I have just replied to about 4 people all posting about debt collector letters which are already covered in the sticky threads too. Think I should stop now and getting bored with repeating advice that's already staring everyone in the face when they join the forum.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Couponmad – have you ever stopped and read all the stickies and posting streams as a newbie ? Especially considering a lot of newbies will be shocked and frightened by the possibilities of the whole issue. There is so much conflicting ‘advice’ and so much SHOUTING.
I’m sorry you have been inconvenienced. If it’s too much bother for you, why do you bother ?
Perhaps it would be useful if someone could spend a while developing a comprehensive, definitive, up to date process with options and implications instead of getting angry, offensive, jaded, bored, shouting and not explaining. RED CAPITALS DO NOT HELP - GEDDIT ????
I did spend a long time reading stickies and the MSE guidance and in the end got confused, more frightened and after making what I thought was an informed choice was told I’d taken ‘Old and unhelpful advice. Ignore it.’
How the chuff are we newbies supposed to know what ‘advice’ to take when people shout at us and abuse us ?
I’m almost at the end of my tether again. We are very distressed by some of the responses from a forum we had hoped would support us and feel more harassed by ‘friends’ than the ‘enemy’.

SEE – I can shout too.
I hope you can all sleep tonight. I doubt we will.
I though we were almost there earlier this evening but after this response I think we'll end up being wet and pathetic and just pay up.
Defeated
Thanks for making us feel worse than the original ticket.0 -
Go for it pay up, be my guest.
Its your loss, ive told you exactly what to do with very very simple step by step advice, if you cant follow that without having a strop then go ahead and pay.
Coupon spends a lot of time and i mean a lot of time on the forum and off helping lots of people who test her paitence to the max,
Why does she do it, because she likes to help against these parking companies
Now if you cant cope with my simple instructions for example and you are just going to pay then please close the door on the way out, you wont get any help when you insult C-MProud to be a member of the Anti Enforcement Hobbyist Gang.:D:T0 -
Couponmad – have you ever stopped and read all the stickies and posting streams
Actually Coupon-mad wrote most of them. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

I apologise for being old
I apologise for being upset
I apologise for being scared
I apologise for being vulnerable
I apologise for trying to help and protect my husband and I’ll apologise to him for failing to do that
I’ll go away now and stop bothering you and I do sincerely hope none of you are ever made to feel as inadequate as I do this very moment.0
