Draft Rejection letter to UKPC - thoughts ?

Hi all

We have a parking charge ticket for parking outside the markings of the bay. We've decided to write to UKPC and reject the charge with the wording below. We've worked on the less is more basis to keep it simple.

Any thoughts ? I don't seem to be able to attach the photo :(

Dear Sir

Ticket No. XXXXXXXXX
Date of ticket. 06.12.2013
Vehicle Registration. XXXXXXX

You issued me with a parking charge ticket as above.

I reject your charge on the grounds that the charge exceeds the cost to the landowner during the period my car was parked.

As can be seen from your own photographs the area next to my car is not a parking space and as such could not be used by any potential customer for parking.

Therefore, the landowner was not deprived of any potential income as the car park is not a pay car park and the retailers at the shopping centre were not deprived of any potential sales.

I expect you to cancel this ticket and write to me confirming this has been done.

  • You need to write it in the third person. So for example, instead of "I reject your charge" it should be "The Registered Keeper rejects your charge".

    Also, have you had the notice to keeper yet ? You shouldn't communicate with them until you get this.
  • Thanks BrightonandHove. I understand why to write in the third person but why wait for the notice to keeper ? My husband doesn't deny the 'offence' and I'm not sure he can keep his nerve to wait for the NtK. He was all in favour of just paying at first and it's taken me a lot of gentle encouragement to get him this far......
    For someone of his age waiting for the NtK may affect his health.

    Because naming the driver affords less protection than to the RK under PoFA 2012.

    Your appeal to the PPC won't be accepted, you want a POPLA code from them. If they make errors in the context of PoFA in dealing with this, there's a much greater opportunity for them to mess up if pursuing the RK.

    If he does not stand up to scammers his health will get a lot worse, they come thick and fast.

    As well as the errors they may make when they issue the NtK, in theory the driver gets the windscreen "ticket" so any appeal at this stage would be assumed to have come from the driver. Well that is the logic I have seen coming from the BPA / PPCs ...

    What needs to stop is the begging of popla codes.

    The Keeper rejects liability for the charge, is an appeal and refusal to issue a popla code should must be taken up with the BPA.

    Some of the information getting included in these appeals in order to beg a popla code is handing solid gold evidence for a court case on a plate.

    Keep it simple and do not beg for a popla code.

    We have seen many PPCs refuse to hand out a POPLA code if they do not believe they have received an actual appeal, and that, for the little it is worth, has been supported by the BPA.

    Yes, But MITIGATION NEVER WORKS, and even rejecting the charge WON'T STOP THEM PURSUING YOU. And rejecting at this stage gives the PPC more ammunition as they'll then likely know WHO THE DRIVER WAS.

    But it's your choice - either accept the advice here or don't.
