  • [FONT=&quot]Hi,

Just wanted a drop a quick thank you and share my story.

My park was parked on a land owned by property developer, I was there looking at their show rooms and got slapped with one of these private parking tickets from P4Parking.

I forgot about the fine and couple weeks later I was tracked down by TNC collections threatening me to pay the fine. On the last day I was almost about to pay for it online but came on this thread and found the template requesting for a POPLA. I sent that with recorded and signed for by Royal mail. I also emailed the property developer about it but never received any response.

In the meantime another letter came from them adding 79 pounds onto the already 100 pound fine and a threat to send it to their "Litigation Department". Two days later a third letter came, stating that "my account" had been closed as their client, P4Parking, had sent it to them in error and no further account will be taken by TNC on the matter. They also apologised for any "inconveience" (their spelling) caused.

To this day I am unsure if the request for POPLA or the property developer caused the "fine" to be cancelled.

But in either case a big thank you to the OP and this forum!!

    Cheers,
    dnxcoded

That's good to hear. It could even be something unrelated, such as TNC having to cancel a batch if they had stated in a letter that the POFA applied and the keeper was liable, when in fact they hadn't complied - or got the data to soon or too late.

If you got a windscreen PCN and then a TNC chaser just two weeks later that means they got your data from the DVLA too early. So I suspect that may have been the issue, spotted by someone and the DVLA might have required all affected cases to be cancelled. Seen that happen before.

But it's all good! Certainly not to be paid!

This thread needs to be trimmed again and the non-FAQ posts archived.
  • I run a small business with my husband and we have a company car which we lease. We recently received a PCN from F1rst Parking. They first wrote to the lease company as they are the registered keepers. We received the re-issued PCN to our company address an month or so later - no driver name - just the company name and address. Obviously we don't have a fleet manager! I am a little unsure of how to tackle this even after reading your threads. I am supposed to pay a reduced fine by tomorrow! I have fought and won on my personal vehicle with fines from Parking eye before so I know it's possible but I really need help on this angle.

It's been asked of the mods before, as has been asked with many ancient threads that receive resurrection, thereby prolonging their natural life by resetting their activation clock, but to no avail.

Hence the big text (I avoided the temptation to set 'big text' in point 72 font :)).
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Doesn't mean they cannot be asked again.

Especially as the cleaner looks to have been into the thread recently!

(And the recent annoyance over the deletion of the currently topical post regarding ignoring debt collectors, which has still not been reinstated, and thus makes the OP's reference to post #4 nonsensical to newbies who are unaware of the recent problem with #4)

It will be reinstated on a quiet day after Christmas!

  • Posting this as an example of what can happen if you take the time to contest an unfair charge, I got all the information I used from this site and forum.

I received a PCN from NCP for not parking in a marked bay, the charge was £100. I appealed via their online form using the templates suggested by MSE, explaining that there had been no spaces available and I had parked at the end of a row and parallel with another vehicle, I was not causing an obstruction of any sort and although I wasn't in a numbered bay, the space had no hatching or yellow lines in or around it that were in evidence elsewhere in the car park. I took photographs of the space and offered to supply them as evidence. Then I waited. Two months later, I received a letter from a debt collection agency telling me that I had to pay them £160 or face court and additional charges. The letter cited the recent Supreme Court win against Beavis just to add a further frightener. I telephoned NCP customer service and was given a number for the PCN department, who, I was told, are unable to reverse PCNs. The staff member in the PCN department said there was nothing they could do once the matter had been passed to debt collectors. I pointed out that NCP had never written to me rejecting my appeal and I would have pursued the matter with POPLA if they had. The staff member told me they had written to me and it was not their fault if I never received the letter and now it was too late for me to take it up with POPLA. I asked if he could email me the letter or post me a copy as I would like the verification code and would be contacting POPLA and the BPA in any case. He told me this was not possible so I said that I would have to assume NCP were denying my right to appeal their decision and not acting with best practice as recommended by the BPA. I also pointed out that as NCP were imposing a charge for what they believed to be a breach of contract between us, if I was taken to court, the case would be NCP vs me, not the debt collection agency vs me as I had no contract with the agency of any sort, so the statement that it was no longer anything to do with NCP was false. The fella put me on hold then came back and said he would need to investigate further and would call me back. Two days later they wrote to me cancelling the charge.

Give it a go, hold your nerve and know your rights, it worked for me. Good luck!
