    I have to admit to not understanding very much of the ins and outs of what's enforceable but I get the gist of it I think. Good luck with the defence, PG and Brogdan. I'm rooting for you both.

    I understand what you say. I have not gone down the CCA route with any. I think the reason is that in the past, prior to the crisis and LBM(s) I have paid off credit cards, closed the accounts and got new ones so I didn't have any really old ones and I can't remember the date when things changed but none from before then anyway :).

    The thing is....if they can't produce the CCA, they can't take you to court can they.....or at least it's not worth their bother? :p Am I over-simplifying things? :o That wouldn't be like me at all :o!!

    You do sound wonderfully upbeat and level headed about this and its difficult to think you wouldn't win so I'm gonna put my money on you :D.

    Well , they produced some random bits of paper after my intial CCA request but they didn't appear to be everything that they should have provided , which they were told and then they went quiet. They then issued the Court Notice and I requested the same again, this time they sent even more reams of paper but again they seem to be missing anything of any importance, so I am hedging my bets that they were just hoping that we would panic and pay up without a fight. From what I know if they cant provide all relevant paperwork, notice of assignments of which they claim we have been sent two, application forms, terms and conditions and the default notice, this wont go any further ! All filed now and my fingers and toes are crossed. If I am wrong we begin making token payments again I guess.

    This will be good practice incase accounts two and three rear their ugly heads again ! xx

    If they can't produce the items they are surely going to have a problem.

    I confess about three years ago I used to lie awake worrying about this happening but now not so. At the time of my LBM I was a bit down on everything and that can cloud the mind and stop us seeing things clearly.

    I think you are seeing things very clearly Mrs. PG but just in case it is worrying you remember it is only a modest amount. If.......(and it would seem very unlikely) they won it would be a CCJ and likely a charging order? Nobody needs a CCJ but you have to look at a charging order as a little increase in the mortgage which after doing an I&E and agreeing a regular payment you can make a priority and quickly pay it down.....and off :) !! If it was £100k or something it would be a worry.......but its not :D !!

    I always feel better when I have a contingency plan. If it should happen to me I would put all other predators on £1 a month tokens and put all my firepower into it and get rid asap.:T

    Unfortunately I do have a CCJ :( It is three years old now :) It was nothing to do with banks and credit though.......water :mad: !!

    I used to have sleepless nights as well Brogden, 2011 it was, worrying about the exact same thing. I'm not sure what has changed really, but I think there has been far more important things going on that make me realise that the sleepless nights really aren't worth it. I still have a few every now and then, but otherwise if I don't sleep, which I often don't its because I am worrying about other things, not necessarily money.

    I cant say I have a contingency plan if this Court malarkey were to all go wrong, I think I will worry about it if and when it happens :o

    Damn those water companies and your CCJ xx

    Have a pounding headache today, too many things to think about and not enough time to do them. Would be quite happy today to curl up in a dark room in my pjs, in silence and hide away , but that wont get me anywhere, so I need to give myself a kick up the backside.

    In order to do this, I have just made a nice little lump(ish) sum payment to THEM of £900. Hopefully they will be pleased with that.

    Checked our VAT account and I have the correct money put to one side ready for the next bill , so unless we have to dip into it, I wont need to do any crazy lady panicking when the return is due.

    Predator who I am considering sending a CCA to shortly has requested a review. I will send them a copy of the exact same letter that I have been sending them each time they have asked for a review since 2012. The "Nope nothing has changed one, I will continue with my £40 per month , take it or leave it " If they don't accept it then I think I might just stop paying them, send a CCA and see if they can come up with the goods, if not I will add them to my Unenforceable list. I have to be in the fighting mood to do that though, and today isnt that day.

    Do the CCA routine with them but be careful with the payments. If you are paying £40 per month then that's 40x what I am paying to some :o !! That isn't quite the point though......

    Somebody who is in contact with them, co-operating, giving them I&E's when they ask and paying £1 a month is a good guy to this lot but somebody who is kicking up and refusing to pay anything is not and problems could follow ;) !!

    IF you are going to stop payments altogether you should tell them formally in writing that you dispute the debt. I disputed my Wronga debt and the DCA acknowleded this and wrote to me to advise that they expected no payments from me whilst it was investigated. It was written off a few months later but I thought it might be :) !!

    Sorry to be such a boring old bar steward but we don't want legal rumblings again. They WILL accept the £40.00 but they would accept much less if an I&E backed it up and they would still love you. I could never believe how much control we have. Sleepless nights are just not on :D

    Hi Mrs PG..hope you are getting some sun!

    just catching up on the last few posts and it seems rather stressful. So sorry that some of these predators are chasing so hard..

    I am hoping to get a tax forecast from the accountant in the next month which I am not looking forward to, but need to do it so I can properly plan. I do pay my VAT regularly but the corporation tax etc has been rather left on one side :o

    Hope the DDs have started on the EB8y postings :D

    Still no Bay of E posting for us Mrs B, been far to many other things getting in the way! A sneaky few days away , Pony Camp for DD2 and work ( whoopee ) for DD1, amongst all the other usual trials and tribulations in this household.

    This is a very very quick posting, I have been working since 7am and I have just about had enough, but thought I would quickly pop on here with an update.

    Not the best update ever ..... but I thought I should mention it.

    The Court Claim that we defended and were hoping to get stayed isn't going our way just now. The claimants have decided that they will continue , and we are now heading towards the small claims court. In the meantime the Predator has sent an offer for a full and final but for now we have decided to sit tight with this one. I am going to spend this evening going through our defence with a fine tooth comb but from a quick glance it appears that we do still have a strong case , but I think our original Defence was a little too weak and vague so needs amending. I need to cram up on some legal jargon and various agreements ie s.78 etc but we will go for it and see how we get on. We have agreed to try mediation as well .

    Head in a bit of a whirl this evening, I am surrounded by work, accounts, court stuff, medical bits and a thousand other things. DD2 been calling , she is at pony camp but it appears they have forgotten to feed the children, they have been there since 7am for goodness sake !! She cant cope without food, she eats liek a horse, although she does have a cool bag full of goodies to tide her over if nothing appears. I thought they were getting a BBQ tonight but it looks like I could have got that a bit wrong ! :eek: Looks like I best go and make a few calls or else I will be delivering fish and chips tonight and I dont relish going out in this rain really !!
