  • i am doing thinks correctly, EH, CAD, shelter and the council have all told me to withhold the payments till the work is done, the council said they have delt with him before, shelter give me the letters to give to him,

    he wants me to give him notice as that why he hopes he doesn't have to do the repairs, hopes to get someone else in,

    told him if hes not happy with me withholding the money till the repairs are done, so I can use 3 bedrooms that I am paying for, he can evict me, but he wont, as he hasn't put my bond in a scheme, he was trying to tell me this morning that he cant afford his mortgage with out my rent and how much trouble he will be in, like I said, as soon as all repairs are done then you will get your rent,


    if he wants me out then that is up to him, and his right as a LL, but I also have the right to live in a house, that doesn't have mold and leaks when it rains, espically, when every tenant he has had, has left because of damp, and the estate agent refused to rent his house out any more, because he wouldn't do any thing to fix any problems, he just hopes people move out or keep paying rent and hope they don't complain

    I went around to the ex tenant this morning, the ones who lived there before us, the people moved out because of the damp, mold, and the fact that the daughter developed asthma why living in the house, they where advised to move


    if I wanted to just withhold rent and wait till he had evicted me, I wouldn't be on here, withholding the rent was my last act at trying to get jobs done, that some that he had been promsing to get done from before we moved in


    I understand that houses get problems and I can live with problems, but when LL wont even visit your property to look why you cant use 3 rooms, some times you have to do drastic things
  • if I wanted a shiny new house I would of stayed in my old house and go for over crowding, but people seem to think that if you go to EH, you are only doing it to get a new house, I just want him to fix the house, which he wont do

    Sorry but you have almost certainly misunderstood this.

    Noone that has half a clue about housing law would have advised this.

    There is a strict procedure that you must follow before you can withold rent and the rest of this thread suggests you haven't even begun to do that yet.
  • weather I understood or not, am not paying him rent until he does the work, if he doesn't like that, he can evict me, he has that right, once work is done, he will get his rent,

    like I told him today, do work, get rent, it isn't that hard for him to do, but he doesn't want to spend any money on this house,

    I would borrow money from somewhere and move while you still have good credit. Then sue for the deposit. If he wrecks your credit and doesn't give you a good reference how are you going to rent a new place?

    Unpaid rent is not going to suddenly affect your credit rating ;)

    Seeing as rental payments don't actually involve the tenant using credit is the ability for the landlord to collect and share data written into the lease ??
  • like I said, as soon as work is done he can have his rent, he just doesn't want to pay for the work to be done, as he didn't want to pay for a boiler to be fitted, as he was hoping I would sort that and he said that today

    one minute he is too busy with work to come see me, next he is at the other end of the country, he is always too busy to come and see me or phone me, but isn't too busy when the rent doesn't go in, as he was phoning me at 8.30 asking for it. all he has to do is fix the leak in the loft/chimney and if this is the reason for all the damp, then he shouldn't have any more probs should he. 1 or 2 days work at most, and he can have his rent, but he doesn't want to, the leak and damp has been there from before we moved in, he is just not interested in sorting the house, just wants the rent and that is all

    he wont fix it and I wont pay rent till its fixed, when the ele blew, he wanted me to sort it and get an ele in to look at it, but by the time they found the prob, it was a easy fix, it was due to damp in the sockets and had rusted the metal on the back of the sockets, he refused to pay the bill, saying I never told you to fix it, just find out what was wrong, when the soil pipe bust out side, I had to fix it as got sick of waiting for people to come out and look at it, as all he would say is I am busy, will sort when I get out of work,

    hes phoned me more today trying to get his rent, than he has in a entire month, when I am trying to get hold of him to fix stuff

    I know the advice you are all giving me, but I cant pay him rent, when he cant bothered to even come out, until he gets sick of me phoning him up, he has had over a week to get a builder to come and look at it, nothing, yet he has builders work on his shops, but cant get one just to come look at a house he own

    he is just not intrested

    Although rent and credit are different. There is a recognition that while a good many people are !!!!less with credit, not that many are !!!!less with their rent to point they are homeless.

    The hope is that more landlords will take on people with bad credit histories if they have a history of always managing their rent.

    This is a good move IMHO, but back to this thread it's not for the OP.
