went to CAB today and spoke to them, they said go to EH, told them the tale, they said, they will give you a house, and will come out, they have to, once they get the forms, he went and checked and said what he told me was right, and they have to come out, what they are trying to do is get people to move out on there own that way they don't have to give you a house, as they are claiming there is none
so left there went to council, they give me the forms, filled them in and fax them off to a other part of the council, women who took paper work away, said i have delt with that address before, so lets see what happens now0 -
just had LL on phone, asking where his rent is, and can I pay it to help him out as he needs it to pay his mortgage
so told him been told to with hold it till work is done, as took him a month to even come look at it, his excuse is he was up country with his ill brother, bloke own business and big houses and been renting out houses for years, yet doesn't know a builder who can come and look at something, with out him looking at it first
told him to evict me then, "I don't want to do that" and is said, is that because you haven't put my bond in a scheme, so you cant evict me under a section 21, waiting for the work to be done and then I will back pay you the rent I owe, (only own 1 at the mo, was due yesterday)
all I am getting out of him is "am trying to sort it" and can you help me out
said what about when we moved in and the heating got comdemed, took 2 months and 5 plumbers to condem it, before you fitted a boiler, his excuse was "I told him I would sort that" like I am going to pay for a boiler to be fitted in a house that I am renting
he said he would give us the ele we was putting on, £15 a day why we had no heating, still waiting, been waiting for jobs to be fixed that where due to be fix before we moved in
got ex tenants and neighbours telling me since I moved in to get out of that house, as it is damp and he wont fix ay thing, just put it down to bad grapes,

OK, most important advice, withholding rent is NOT a good idea.
Have you notified your LL of all the issues in WRITING?0 -
yes and he ahs been to house and know what the probs are, just had council on phone and what I am doing is right according to them0

The council are helpful, but i wouldn't trust their legal advice.
Follow this procedure if you feel you must withhold rent.

Reasons for doing so:
You want to get your deposit back, you may have to take legal action to do so.
Court's will likely not look upon you favourably if you don't follow the correct procedure.
Basically you want to be squeaky clean whilst the landlord looks dirty all hell.*Assuming you're in England or Wales.0 -

OF COURSE EH need some basic paperwork (name, address, description of problem with timescale etc) for their records before they can act. Did you think if you just turned up at their office ranting about your rubbish house and waving some phone pics at them they'd give you the keys to a new, empty house that they had waiting next door?
You've been given a lot of excellent advice by patient, helpful posters but you are not remotely interested in following it.
Your landlord is clearly an idiot, but you're doing yourself and your family no favours either.They are an EYESORES!!!!0 -

OK. Then you need to 'play the game' with people like the EH, who will help you but will need you to work with them, as many of us have already said.
And again, I understand your frustration, but withholding your rent is a very bad idea at this point. It might make you feel like you've done something in the short term but it will end up probably causing you more trouble in the long run. Much better to follow the advice you've already been given here about taking action against this LL properly.If you don't stand for something, you'll fall for anything0 -
Ihatemyhouse, I really sympathise with you, those pictures are horrendous.
But please take the benefit of my experience.
Some years back I was in dispute with someone where I was utterly morally and more importantly in the legal right.
in the end I just said, "sod it I'm not paying you anymore money I'm walking away"
A few years later, a CCJ pops through my letter box for £5k despite the original dispute being for £800.
It caused a house sale to fall through, I had notice on my rental and faced the prospect and not being able to rent anywhere else.
Also at the same time, I had give notice on my job and the new job I had accepted was then rescinded due to the CCJ
I faced having no job and no home.
With my back to the wall I was forced to go through due process.
First of all I had the CCJ removed using the court process.
I was then sued again, which I won by following the correct procedures.
Then considering the damage and harassment I had received, I then decided to sue the other person.
In the end I won, not only did I get back all of the money I had paid all those years ago, I was given damages by the court.
I was awarded £5k, the other party was left with a legal bill approx of £10k.
Moral of the story is despite being in the right, I was for a period of time completely screwed over. Only when I undertook the correct procedures did justice prevail.
If you don't play the "game" he certainly will.
One thing your LL and the person who I had a dispute with have in common is that they rely on people not knowing their rights (far to many people in this country don't know them, which allows scum like this to profit)
Sounds like he been getting way with this years, bout time someone stood up to him. apart from having a satisfactory outcome to your case, there is a certain satisfaction in knowing you have cost the other party a lot of money.
but you can only do this, if you do things correctly!0 -
