When did you do that? What was it exactly you said?

My reply to the surgery practice insurers:

Thank you for your letter dated 15/1/14 with your offer of £2162.78 in regard to my claim.

In reply I would like to say that I was very disappointed at your decision that the money paid for the surgery that killed my dog will not be paid back. This to be honest was the most important part of my claim as having paid this I feel I have paid for the death of my dog. You said that this cost I would have ordinarily incurred however this surgery would not have taken place if the vet had read the blood test result correctly therefore due to their error this cost was incurred. Furthermore as far as I am concern the surgery was carried out without my consent as the consent given was on the basis of the pre-op bloods results showing that my dog was fit for the surgery this however was not the case. If I have been informed of the results I would have never given the vet go ahead.

Secondly your offer of £200 in respect of the shock and distress I have suffered I find a bit insulting. I have not made a claim for the sentimental value of my dog but for the shock suffering and stress that I had to go through not just when my dog died but also for the past year dealing with this matter and suffering further shocks as the truth how and why my dog died in such terrible way started emerging and was finally confirmed by the forensic vet on 20/11/13. I have been pursuing this matter to the point of obsession and even after all this time find it difficult to come to terms with what had happened and why.

In the circumstances I will be passing all the documentation to my insurer’s legal team and I shall get back to you regarding your offer after I have heard from them.

Doesn't sound too bad on the face of it but very emotive of which you've been advised not to be.

You finish your letter saying that you have past it to your insurers and shall get back to them regarding their offer after this. You say above in your post that you have said to them what you want, seems like they might be waiting for your next response and I dont believe you have told them outright.

So if all you want is what they haveoffered plus the costs of the surgery, then reply to them saying so and see what they come back with. They might bow down to it because you wont let this go, they may do so because they believe you took advise from your insurers as you told them. You need to respond directly to them now saying hat it is you want, something along the lines of:

With respect to your letter dated ***** and my response dated ***** I have taken advise as stated and I would be willing to accept your original offer plus £412 for the surgery costs incurred for the reasons I outlined in my last letter. I will accept this in full and final settlement. I look forward to hearing from you.

    yours

Thats it, nothing else, no reference to Maxie, shock, distress anything else, small, concise and succinct.

Yes I see what you mean . However I have acted on impulse when I got their offer and replied how I truly felt about it.

Well if their offer plus the cost of surgery will close this chapter send something along the lines if what I said nothing more and then await their response, hopefully you can close that part off and if you want to pursue a change with regards to DEFRA do so

Sadly no money will close this chapter

To me there is no price that can compensate for what I went through , what I have claimed for is just a token.

I know this is going to sound blunt but if there is no price then you don't need money. I can't see this 2K you want to be anything else but greed for an unfortunate incident.

OK let's break down my claim in bits.
    Economic value of Maxie £650

    How did you calculate that?
    hachette wrote: »
    Barrister advice £360
    Post mortem report £385
    other vet'e advice £72.78
    Forensic vet report £360

So, that's £1177.78 you spent on "advice", yet you've also left out the 40 pages of help you've been given on here. If I'd realised that everyone else was billing you for it, I would have too!
How much of that advice told you that you should sue and you would definitely win?
    1. Have you tried to Google the answer?
    2. If you were in the other person's shoes, how would you react?
    3. Do you want a quick answer or better understanding?
