I've followed the first two templates with EE and they asked me to go to CISAS. I've asked them to provide me with deadlock reference and just to scare them off also told them, I don't want only CISAS, I also want to go to small claims court. This is the reply I have received :
Dear Mr xyz,
Thank you for your further email dated 4 July 2014.
I acknowledge your request for a deadlock letter, however please use these correspondence as reference that we cannot reach an amicable resolution, as we are not legally obliged to issue a deadlock letter.
I trust that this response meets to your satisfaction.
Yours sincerely
Mark
Would you suggest me to use previous CISAS applications+evidences that you guys have used? Or should I use something more recent for a successful claim?
Also - my original plan of £41 has been significantly discounted to £16 per month due to various issues in this contract. Does it make sense to ask for termination as I still have 13 months left on my contract (2 lines)? Will getting this much discount change anything as I understand they are increasing price on £41 contract, not £16.
Will await your response before I make an application in CISAS.
You only do SCC if CISAS fails. SCC won't even entertain your case if you haven't gone through CISAS. You can't win at CISAS and then goto SCC, as to go to the SCC you have to reject the adjudicator's decision at CISAS.
You'd have done better to tell them that if you fail to reach a satisfactory decision with CISAS, then you'll take it to SCC.0 -

Wow. Such a simple solution and I can't believe I didn't think of that!!
:T
Will sort this out now, cheers!0 -

Thanks a lot! I should have thought it first! No wonder, he didn't care. So now, will go to CISAS and probably as the recent trend goes, my claim will be rejected outright. Once that is done, hopefully will be able to join the few of you here, who are thinking to go to SCC. Do we even have any defence for SCC? As you can clearly tell, I am a newbie to everything legal - me and courts have never seen each other, other than in movies!0 -

RandomCurve knows the details better, but I think the crux of the argument at SCC will be the same defence as used at CISAS - the definition of Material Detriment was defined (any change that isn't neutral to the consumer), and therefore a price increase is Material Detriment. I also imagine that the fact that the majority of folk won at CISAS will make up part of the argument.
I'm the same as you, I knew absolutely nothing about any of this stuff. I still don't really know how the SCC will be set up, other than a vague idea, but by the time I got through CISAS I had a bit of an understanding of what our arguments were!0 -
I have had Stacey Edgar appointed as adjudicator in case against EE, using response to their modified defence.0

Ok,
I've sent off my acceptance back to CISAS for my own contract and now waiting for EE to get back to me. Now, my contract is up the end of August it may well be that I'll be out of contract before EE settle up if they mess around with the back dating lark!
With my daughters case, I've just got EE's defence back and it's identical to Karlito's defence in post #1072 save for merging para's 28 and 29.
So would I be good to go with Random Curves responce at post #1106??0 -

Mind if I ask when you heard? I put mine in last weekend as well but have not heard back from CISAS yet0 -
Morning, just after a quick bit of advice.
I've just received my PAC code from EE, however its for 2 numbers. Can 1 PAC code be used on separate occasions?0 -

I haven't heard back anything from CISAS yet either. Put in my case last week. Haven't even had any confirmation by email that they've received my case!0 -
Just had an email from CISAS. Reply to defence was sent in on Sunday 29th and I have been assigned to a Mr D.S.0
