Undersize mattress

Bought a king size Harrison mattress from local retailer. Should have been 5 feet wide but came 4feet 9inches. Complained to retailer. Told it would settle down after some use and it lying flat and being regularly turned as per their instructions. Mattress is still not 5 feet wide after 3 months and we have complained again to the retailer who contacted Harrison's who sent a representative to look at it. He said it would never fit our 5 foot bed and that it was made to metric measurements 1.5mtr which in my calculations is approximately 3/4inch shorter than 5 feet. Would accept this size but not the gap we have on the bed at present.
Anyone else had this problem as the mattress was not cheap and supposed to be handmade.
Where do i stand legally as it is not 1.5mtr or 5 feet wide and we have stated all we want is a mattress to fit the bed and what we paid for.

Cost £900 and being paid on interest free direct debit paymentsand the deposit paid by credit card.. Personally I'd write to them saying you ordered x item on x date for x price and on x date, the item was delivered and it became apparent it is misdescribed and doesn't conform to contract - which you notified them of on x date. You are requesting a refund as per SoGA and give them 14 days to respond.

It might technically be within manufacturer's tolerance. Also, I believe that many mattress (and bed) companies have now switched to metric measurements so finding a replacement at exactly 5 foot might not be possible.
I'm not saying you're not allowed a refund but if you got one and bought another mattress the same thing might happen. One day all mattresses and beds will be that size.Hi. Still a big difference between 4'9" and 5' though.
From a (very) quick look these are the Harrison measurements:-
5ft King size (150 x 200cm)
Which means it is 4'11" wide (or should be)0 -

You sound exactly like the customer service man i spoke to on the phone who refused to deal with the problem other than telling me that my problem was with the company i bought it from. If the mattress had arrived at 1.5mtr i would not be complaining as it would have settled out and be nearer the 5 feet i ordered, but it arrived approximatly 5cm shorter.Chickabiddybex wrote: »It might technically be within manufacturer's tolerance. I wonder what the retailer that the op purchased the mattress from would have said if when they went to pay for it, the op said that they were only willing to pay £855 instead of the correct price of £900.
After all, they would only have been paying 5% less.0 -
Did the rep measure your mattress or give you any sort of report?
You will have to keep going through the store you bought it from not the manufacturers, who was it who came to have a look a store manager? If not happy ask them to send fira to come and give an independent report, though sometimes the company will charge you the £80 fee if the conclusion is not in your favour.
Sales of goods act it doesn't do what it was sold for to fit in a kingsize bed if it was 3 inches bigger you be in trouble.
I would suggest going into the store you bought it from and speaking to the manager, don't kick off its not their fault but you will need to go through them and you usually get further if you go in person.
You will probably have to keep chasing because the manufacturers won't think it much of a problem as it sits within the bed frame, if there is any other niggles with the mattress now would be a good time to bring it up too. Hth0
