    Yes, they can get your data because they are a member of the AOS at the BPA Ltd (the AOS is an 'ATA').

  • I've been reading the POFA Schedule 4, which states:
    (2)The notice must—
    (h)identify the creditor and specify how and to whom payment or notification to the creditor may be made;

    Does it specifically need to say "the creditor is....", because from what I can see on my PCN, at no point does it state the creditor?

    Yes that is one of several things wrong with Excel's Notices and procedures. Here's how to word that bit at POPLA stage (this thread has a good POPLA appeal example):

    Thanks. Although my PCN doesn't say "you have the responsibility...", it says:
    You are notified under Paragraph 9 (2)(b) of Schedule 4 of the Protection of Freedoms Act 2012 that the driver of the motor vehicle is required to pay this Parking Charge Notice in full.

    That sentence also mis-states the position because the POFA 2012 says nothing of the sort!

  • Another question, as it bears relevance now:

    When I was sent the PCN, it went to an old address* as I was in the process of having my RK details changed to a new address. Now that it has been updated, are they likely to send it to the new or old address?

    * I knew about the PCN because it was a family home as the old address.

    They should reply to the address you have given on your appeal, if you gave a postal address. But ask the family to let you know if you get a letter, as it's urgent!
