    Okay, thanks that's useful.

The good news is that all is not lost. You need to write a robust response to them regarding their most recent letter and demand a POPLA code.

I am going off-line for a while - I'll do a letter for you when I come back, if no-one else has replied before that.

You then have some reading to do, as you need to prepare an appeal to POPLA - we'll point you in the right direction, and check your appeal before it goes off (don't go it alone), but we can't do it for you.

    Thanks, I appreciate your help.

EDIT: If it did go to POPLA, would the grounds of appeal be the parking charge (ticket) exceeded the appropriate amount and the vehicle was not improperly parked?

You've not said (as far as I can read in your thread) what the actual charge price was, and what 'appropriate amount' are you working on?

Where in their correspondence with you have the stated that your vehicle was 'improperly parked'?

If you're going to base your POPLA appeal on those grounds, good luck!

You seem to be throwing some very odd and confusing points into this!
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Wow you are believing the POPLA grounds are set in stone when they are not, like several newbies have done before. In a way, yes, those would be 2 boxes to tick (as well as 'I am not liable for the parking charge'). But these words wouldn't be your actual argument!

In fact I have already given you a link above which gives example POPLA appeals. Did you miss it? Post #5.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I know I couldn't base them on this argument alone, just trying to understand it.

Not missed it, just haven't had chance to look in more detail. I'm just trying to get my head around POPLA, hence asking about grounds of appeal. It's not something I've ever dealt with before, so I'm just trying to build a foundation for me to understand it better. Like I say, I appreciate your help, that's why I'm trying to get as much information as possible.

The charge price is £60 if paid before 14 days, £100 between 14-28 days.
The PCN is issued to VRM XXXXXXX for allegedly breaching the car park terms and conditions in the Privately Operated Car Park at Providence Street - Wakefield.

The alleged contravention was detected and recorded by the ANPR cameras at the site on 27/09/2013 and the reason for the contravention is: Parked without displaying a valid ticket/permit.

This is what the notice says in regards to the actual contravention. Does this help?

    Just to double check:

1 what location does it actually state on the PCN? The reason I ask is that as far as I know there is no car park on Providence Street, just street parking.

2 Is it a permit holders only car park?

3 What period did you stay, and what is the fee charged by the pay and display machine for that period (just assessing GPEOL)

    thanks

    1. Wakefield, West Yorkshire WF1 3BG ‎- Do Street View and you should be able to see it. I can post a screenshot later if it makes it easier for you?

    2. No, just a 24 hour P&D Car Park.

    3. Duration of stay was 91mins - as for the cost, it was £3.60 I think (put £4 in and didnt get change, hence the "I think" (it does say no change given but I didn't see that until afterwards)). We paid for 3 hours which more than exceeded our stay.

It's not the best standard of car park by any means (lines are faded, uneven surface) but on the night in question it was the closest and most convenient car park!

Search the car again, under seats that kind of thing.
Saving parking receipts is very important in a scammers car park.
They are famous for these fishing expeditions as well.
