    because that is what will happen if you do not get this charge cancelled, and as its been going on since may 2013 , time is of the essence in countering their claims

    this is what happens if people dont get on with it, people who ignore letters

    if you nip all this in the bud, no court claim will follow

    BUT until its cancelled or sorted out at popla, a court claim may be issued

    until now neither has happened , hence they may issue court papers due to procrastination (delaying tactics)

    hence the get on with it replies

    ps:- I cannot see 28 days being the end of jan 2014

    there are 31 days in jan 2014 and your wife has had the pcn for a few days at least afaik

    OK, I stand corrected. Maybe 3rd week in Jan. She isn't here at the moment but when she comes in I'll suggest she does it. I don't see as they would send her a PCN and then issue a court claim before her 28 days are up

    frankly, you are extremely lucky that YOU as RK have not yet received court papers or an LBA or an LBCCC already about this, many people have as PE have been issuing them like they are going out of fashion

    I am not convinced you understand how serious this can become, so please read some of the other threads where the court cases are being discussed, it frightened me and I do not even have a court case pending , whereas in theory , you do !

    on the other hand I have helped relatives win cases with excel and pe , which up to now you have not

    umkomaas , kirbyinfurnesslad , stroma , coupon-mad , guys-dad and many other respondents have also helped many others win various cases, even in court

    their replies, like mine, urge you to GET ON WITH IT in order to prevent you having these bad experiences worsen, especially as your attention to detail isnt as it should be (given the aldi email thread and this expiry date issue for starters)

    when your wife gets this popla code, make sure you have ALREADY drafted one up and had it approved on here , for sending ASAP , as they have a very strict deadline of 28 days for it to arrive , no beating about the bush or procrastinating on that one !! time is of the essence here ! so start on it NOW !

    until its cancelled or resolved at popla, anything is possible, especially with PE

    I AM getting on with it. I am sitting on here drafting a response to Aldi right now. Once my partner returns, I will ask her to do the soft appeal and I have already started drafting a POPLA appeal

    Do you really think we are likely to get a court claim before a POPLA code? (Isn't that half a defence on it's own that we requested a POLA code and PE would have made a court claim without using the industry recognised arbitration service?)

    BT, I have already been through 2 small claims as a plaintif and it may suprise you to mear that I have a 100% success record

    but guys-dad told you 9 weeks ago in post #2 on 20 oct 2013 to get on with contacting aldi and getting it cancelled, yet you say you do not procrastinate ?

    as for the court case, they have it pending , you can be sure of that, they just have not issued the papers through northampton yet , probably as they havent filled in the RK or driver details as yet, but it will be in their "court cases pending tray"

    of course, if you wish to go down that route and defend yourself in court , feel free to do so, I have no issues if you take them on and beat them at their own game , I would welcome it and ask you to publish your victory too , so we can all see it and coupon-mad can add it to her list of successful court cases

    so please ignore my entreaties for you to get this sorted in the more usual manner

    but if it were me , I would have been making bacon butties and cups of tea for the people at aldi until they got the matter cancelled from may 2013 onwards , especially in october 2013 onwards when you were told to do so, and not on new years eve 2013 onwards (and you ask me about procrastination ? ) ;)

    I really can't understand what provoked that post....

    Where on earth have I suggested that I would prefer to go to court? Next you will be asking why we're up to 10 pages or whatever it is now

    That should have read BTW in case you're not sure but was a side comment and doesn't make any suggestion that it would be my preferred route.

    Maybe now we can park all this sillyness and get on with the matter in hand.
