if you had read the thread for Newbies, you would have followed that, had no further questions and just sent the appeal of.
Frankly a soft appeal is not that important, its just to get the Popla appeal code.Proud to be a member of the Anti Enforcement Hobbyist Gang.:D:T0 -
you should add something like this too , at the bottom
frankly I think like most people reading this you have delayed long enough, whatever you do , get it to them asap or this will still be going on in a years time or in 2015 never mind 2014

I have followed that...and read a number of other threads that I've been pointed to. There seem to be almost too many people offering (sometimes conflicting advice). I do appreciate the help but it can be a little confusing and contributes to lengthening the thread0 -
stonker, this has been going on in your case for 8 months !!
you posted about it 2.5 months ago and several posts and linked threads explained what to do back then , with links to examples
I merely copied and pasted from a post made recently on this forum by stroma in another thread , the post is pretty much a standard soft appeal and examples of it are posted daily on this forum , not only that I read this thread yesterday and posted the link in your other thread about aldi customer services which was on page 1 of this actual thread

I am as the registered keeper of ( reg) and in receipt of your notice to keeper xxxxx dated xxxxxx, all liability to your company is denied, so as the registered keeper I wish to invoke your appeals process on the following:
1) This charge is not a genuine pre-estimate of loss
2) You do not have the authority or permission to give these invoices to motorists
3) Your signage is inadequate, and does not comply with the BPA Code of Practice
4) No grace period has been given to enter and leave the car park
You are therefore invited to cancel this charge now, or supply a popla verification code to appeal to them on rejection, where you will be asked for a detailed breakdown of the above.
As you know all appeals on the points above are upheld.
Please confirm cancellation within 35 days of the above date

my reply was to add the "standard reply" to your "mitigation and threat" reply, so all bases are covered
alternatively, you can send a simple one like
cancel or send me a popla code (it has been done before)
in this case I think your soft appeal and the simple addition covers both bases , but after all this time its time to get something done, no more hesitation
same with aldi too, get an angry letter in to that customer.services in about post #11
no more beating about the bush , be pro-active, get on their case and whip them into submission , even if its at popla
we really do want you to win, but too much gas-bagging now , time for action - thunderbirds are go !!

ok, i'll add a summary.....
doesn't the driver have to do it now as they have been named?
The RK has already submitted the following to PE:
With further reference to my letter dated 9 December 2013 wherein I gave you the details of the driver of the vehicle at the time of the 'event', I understand from the driver that no correspondence has yet been received from you.
I must inform you that having now consulted the driver further, any attempt to enforce your fake parking ticket will be most rigorously defended on the basis that neither of us are liable. Your charge is not a genuine pre-estimate of loss which as you well know is a defence proved to stand up on its own every time under POPLA appeal.
Should you decide to pursue the matter against the driver, they will quite simply offer the above as a principle argument in defence. I therefore invite you to simply cancel this unenforceable speculative invoice to save any further undue stress on the driver who has been on medication and receiving counselling for depression and anxiety for a considerable period of time.
Alternatively, if you insist on pursuing settlement in respect of your unenforceable fake parking ticket, please feel free to send me a POPLA code so that I may deal with the matter as the registered keeper of the vehicle
