they replied when they sent the pcn to the driver
you should always complain to the landowner to try to get a ticket cancelled, doesnt matter what else is going on , its the basic principle of all of this especially when you dont get enough time to do the shopping and get out of the car park before their self imposed deadlines
I would be complaining to aldi regardless of who has an NTK or a PCN
as RK you are no longer liable as the driver has the pcn, so it is the driver who appeals that new pcn and either gets it cancelled OR gets a popla code
so the course of action is surely this pair :-
1) driver appeals the new pcn for cancellation or popla code to the ppc
2) you send your complaint to aldi as in that post you made earlier (#89)
that is my opinion anyway

I only wrote the night before getting the PCN so they obviously didn't write in reply. Obviouls my reply crossed with their PCN to the driver. I'm therefore suggesting that I give them a week or 2 to respond to that communication before the driver appeals
I HAVE already written to Aldi (#54), they replied with a standard letter whicjh failed to addres the equality issues and was clearly just a standard letter. I'm now asking if I should reply with what I posted in #890 -

the point is that like dominic littlewood you act like the squeaky wheel, you keep on , and on , and on , and on at them until they oil the wheel to cancel out the noise
in this case cancelling the parking charge ! coupon-mad told you that the problem with being on "hold" is that they think the ball is in your court , so like a tennis match you keep batting it back , batting it back, ad infinitum until they get so fed up they cancel the charge just to get you off their backs
the ppc and DR will keep getting on the backs of people they expect to pay these charges, so you have to fight fire with fire , it may be being back at the school for the blindingly obvious but its what works !
the driver has a few weeks to appeal to the ppc so that can be done in the new year, just dont miss their deadlines as the idea is cancellation or a popla code, then you win at popla , case closed
popla cancellation may be the ultimate goal here, but as mentioned by coupon-mad in her sermon in the sticky thread, always try to get the charge cancelled by the retailer or landowner , that way you dont even need popla0 -
Whatever you decide to do, don't let the driver miss out on PE's 28 days appeals limit. My advice would be for the driver to appeal straight away and get hold of that important POPLA code (which really does mean 'game over' for PE - with our help).
To me, it's a no brainer to delay awaiting any other outcome - you (and the driver) currently have the upper hand. Use it!Please note, we are not a legal advice forum. as you have named the driver you are no longer liable for the charge, so I do not believe they can or will send you a popla code , seeing as you discharged all obligations when you named the driver
so as the driver now has a pcn, it is the driver who has to appeal and gain a popla code, not you
in other words, I am saying that from now on you will not get nor ever get a popla code for this parking charge , because you handed that ball over to the driver - the driver being solely liable for the parking charge and you now being exempt0 -

depends, if you read my thread I got the charge dropped in the soft appeal, but had receipts so sent in copies, also asked for a load of legal stuff if they rejected the appeal, as well as demanded a popla code too

in this case one of the simple cancel or give a popla code appeals usually works (as I cannot see them dropping this)
aldi may cancel it which is why you should now concentrate on aldi, leaving the driver to appeal it to the ppc and to popla0 -

OK, maybe I'll try some of that too.
I will send post #89 to Aldi in reply, we are also keen to push them on the equality issues as I really don't believe they should be putting my partner through this. I therefore think my partner should write to both Aldi and PE requesting that they stop this harrassment bearing in mind that the is suffering with depression and anxiety0 -
fair enough, but the only reason this has gone on for 6 months and still isnt resolved was that you ignored it right at the beginning when it could have easily been sorted out in the same manner as you are doing now and its being dragged out more and more
if you had pressed aldi this may have been cancelled weeks or months ago
if it goes to popla then I expect you will get a popla date of feb or mar 2014 , win at popla and it will have dragged on for maybe 9 months ?
we could have helped you nip this in the bud months ago if you had asked for help after the first NTK
sorry to be blunt about this but I spent some time reading this saga tonight so its fresh in my mind
but the good news is that you can still press aldi, and your partner can soft appeal and then popla appeal it and get it cancelled anyway
so all is not lost !
maybe have a few days away from it , then do as advised by the 3rd jan 2014 to be sure of getting within any deadlines
