A sign should be at the entrance as you choose to enter the land - there is none. And as you say, the ones that you took a photo of are not readable from a car.

So I would send that letter!

Great result, very pleased for you. :T

And do know what you were saying just 7 days ago?
If there's a chance we will lose at POPLA am I better paying up now to avoid paying the full whack?? Can't really afford either at the moment, but it almost doubles if we lose!

For those of little faith, we do know what we're doing here, glad we could help you :)
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

I absolutely believe you know your stuff, and I am SO grateful for all the advice. BUT I think it is important to recognise that, faced with one fine, and a potentially even larger fine, one can feel a little uncertain and question the best way to proceed! After hours of research, reading BPA code of practice, POPLA outcomes, researching the parking company, and speaking to people on here, I did eventually feel confident I could win against these sharks. I could imagine those for whom research and written communication does not come so easily, may be a little daunted by the prospect of taking on one of these companies... I can see why some would be reluctant to fight these charges, it's initially a very daunting prospect !!

We know how daunting it was so well done for taking that leap of faith we pushed you towards. So pleased to see the letter scared them off!

I will post your success for posterity in post #2 of this sticky thread (yours is the first one about Spring Parking as they are so small).

Always appeal and prepare to win at POPLA (and complain to retailers & landowners who contract with them!) about ANY private parking charge in England/Wales.

  • I'm sure a quote carefully lifted from the email I got back from the shopping centre owners also helped my case ;-)
