    Did you take a photo? If not, do get a few pics at the weekend (of the wording and the position of the signs). I am just wondering whether the signs will be alleging 'breach of terms' or not. I know the Charge Notice does, but what exactly do the signs say?

    This is a small firm we don't see mentioned very often and I want to make sure that to argue 'no pre-estimate of loss' among other arguments at POPLA will stack up. I want to discount the possibility of them saying the charge was contractually agreed by the driver.

    But send your appeal anyway.

    Come and join us! We all started like that! I even help people with Council ticket flaws on pepipoo forum and have never appealed one myself. I just have a hatred of scams and a good memory for facts, threads, wording and regulations. :D

  • If there's a chance we will lose at POPLA am I better paying up now to avoid paying the full whack?? Can't really afford either at the moment, but it almost doubles if we lose! I have found one receipt so far/ definitely from a store that the car park is for, and time shown is during the 'overstay' period. Should I send that to the company who manage the car park?

  • Without sounding rude, you really have to decide what you want to do here. The facts as they stand at the moment are

    a) You can still go to POPLA appeal with people's help on here. There is a 100% success rate of appeal as it stands with people's help on here.
    b) You haven't mentioned that you have pursued the landowner. Do this NOW and do this AGGRESSIVELY. Speak only to top dogs and do NOT be allowed to be fobbed off. They can get these tickets cancelled at any point.
    c) Spring do not have any record of taking people to court (it costs them money!), so show that you are willing to fight and have the knowledge of the legal relevant information and there's a good chance that they will leave you alone and move onto the next mug. This may change, but there's no reason to suggest it will.

    All three options (one of which guarantees a win) have been mentioned numerous times as options in this thread, yet you are still thinking of paying. It's your decision dude but you need to make a rational decision you are happy with. I certainly wouldn't pay when there's a free win on the table.

    I would love to get the ticket cancelled by POPLA! But until I can find something concrete that I know will win an appeal I am cautious about this approach (I appreciate that this may seem ridiculous to those with intricate knowledge of the whole process, but to me, having never had a ticket before and being faced with a slightly overwhelming amount of info on the whole thing, I'm feeling a little stressed- and £95 is not money I can afford to part with, as I have a young family). The signs seem pretty clear, the CCTV images are clear and not retouched etc, they have issued the Charge Notice within the time limits... Coupon-mad mentioned discounting the possibility the charge was contracturallty agreed... If I did contracturallty agree the charge due to the signage I interpreted that to mean maybe I would not have a case to appeal, hence wondering if I should thus pay!     And I am going to contact the landowner again tomorrow, I fully intend to Pursue that route, my initial contact with them was not wholly promising, but I am going to email them using the advice I have been given. I am still reading through threads on POPLA appeals. I apologise if I come across as indecisive or ungrateful- not my intention at all- I am extremely grateful for all the help given- but also feeling a little overwhelmed too!

    Don't Worry Stig!!! I'm in the same position as you too. Only with UKPC, i have started by complaining to the retail manager.
    As my complaint has got 'rejected' (today) I began to think oh I'll pay the 35 within the 14 days, rather than the 70 after.

    But I've my trust in the MSE guys, and the 100% POPLA win case.

    Together, we'll fight these cowboy PPCs.
