  • What does PE stand for? (Sorry- I should probably know- still getting my head around all this!). Thanks again everyone :)
  • I can't figure out who the retailer is jeanraffio- it's a car park in a town centre :-/
  • Sorry PE is ParkingEye, another PPC - just potential that Spring would follow a similar path of action - sorry of that wasn't clear.

What's the name of the car park? And which town is it? Simple web searches can turn up these facts a lot of the time. If it's a multiple retailer car park, complain to them all! Which shops did you visit on that day at the time of the alleged offence? Do you have receipts?

You are being far, far too indecisive and not reading the advice you are being given.

The purpose of your appeal to the PPC is to get a POPLA code. Their business is based on motorists contravening their so-called rules and contracts. Your opening post confirms that you are "Guilty as charged" and broke their rules.

The chances of them saying "Yes, Stiggy, we agree that our charges are extortionate so we will cancel the charges" are so remote that they make MARS look like your next door neighbour. It's their income, for heaven's sake. If they agree to cancel, they go out of business.

Yes, get the retailer to put pressure on them to cancel the ticket by all means.

But you need to appeal and get a POPLA code. Some PPCs will not give a POPLA code on the point of punitive charges saying they are within BPA rules and then you get in an exchange with them that erodes your POPLA window.

It doesn't matter if you think their signs are 100% compliant. Most are not and have deficiencies that people with more experience than you might detect.

It comes down to this. If you don't want to pay and you get no help from the retailer, your best bet is POPLA. Currently it's easy with 100% wins from people following out advice.

If you think the PPC will fold because you tell them that their source of income is invalid, then you are being very naive.

Please pick an appeal point that encourages them to give you a POPLA code such as signage (as they think they will win that at POPLA).

    And stop !!!!!footing about, !!!!!!.

Thanks for your reply, you make some valid points and your info is very helpful :). I disagree that I am not listening to the advice given- I am taking it all on board, but may seek clarification, esp where I get conflicting advice and/ or info, whether on this thread or from other threads I have read. Rather than being indecisive, I am really trying to ascertain my best approach to dealing with this, before proceeding.

Thanks again for your advice though, I am a novice here (and yes maybe naive too!) so I appreciate any/ all support and advice given

I visited loads of shops and made maybe 3-4 purchases, I am in process of looking for the receipts but we are having building work done so haven't been able to locate them yet (house is a bit of a mess due to the disruption). I understand I'm not supposed to identify my case on here in case the company read it? I'll try googling it- I think it must cover several retailers and I don't know which, so unsure if I made purchases from any- although I park there all the time and use all of the shops in that area

I don't think naming the car park in question will prejudice your case in any way. No doubt 100s of tickets are generated there, and somebody may know it personally in order to assist?

  • Jeanraffio- I have found the name of the company who own the car park and contract the company to manage parking. I rang them and was told they won't cancel a ticket without 'very good ' reason but suggested I put my request in writing (by email). They have supplied an address. I just went to write the email and realised I don't know what to put- I can't use 'I' but also shouldn't name the driver should I? How should I word the email? It won't come across very well if I just put 'the driver' and as they would be intervening as a gesture of goodwill I don't want to come across rudely! There was no option to speak to this person- only email. Thoughts welcomed! Thanks again :)
  • It's a car park run by 'Decorum' and they contract Spring Parking.

I would be firm and direct with them. Write as registered keeper informing them that the signs in their own car park do not adequately convey that there is limited parking time. There are a number of other points that you could raise (grace periods, equality acts (i.e. was someone elderley or you had young children with you at the time etc))

Tell them that you are disgusted that they use a PPC to persecute and threaten honest shoppers (of which you are one) with twisted and incorrect legislation and that if they do not cancel the ticket immediately you, your friends and your family will not use the retailers or the park again. Additionally, you will be making people and the press in public forums (Facebook / Twitter etc) aware of this corrupt practice.

As stated on a previous thread, there are a number of formal complaint letters on the forum and here's part of mine that I sent to a retailer recently (irrelevant stuff redacted):

I have researched the matter and intend to escalate my challenge against ParkingEye regarding the above. However, I am giving [retailer] the chance to quash the fake PCN once and for all because I feel you need to know that you and your agents are both interpreting the law incorrectly for their own profit, and also bringing a hugely detrimental relationship to your customers (of which I include myself). This is wholly not acceptable and not something that I expect from a company that I have been a patron of for a number of years.

It's my view that if you are not aware of these tactics by ParkingEye you should familiarise yourself with them (a simple web search will bring up hundreds of examples of their reprehensible tactics). It may also be time to reassess your corporate relationship with a company who employs this underhand and borderline illegal approach. Clearly I have better things to do with my time than explain legislation to your agents, let alone correcting them on their interpretation of it.

Please be aware that if this is how [retailer], through their agents, treat genuine long term customers I am minded, along with friends and family, to not to return to [retailer] in the future.

I trust that you will treat this complaint with more urgency and importance than your Customer Service team did at the store.

Don't be nicey nicey about it. Ask them forthright to cancel this ticket immediately.

They CAN do this simply, a phonecall from them to the PPC is all it takes.

@jeanraffio - some great posts you've made here, excellent stuff. :T

I do hope you can join us regular contributors on a longer term basis in helping newbies and taking this fight to the PPCs (welcome aboard - if I'm not being too previous) :)
