1. Did Steve at the BPA ever tell you the outcome of his investigation? If not then email [EMAIL="david.m@britishparking.co.uk"]david.m@britishparking.co.uk[/EMAIL] and ask him for an update as you know Steve is away (because MSE forum posters told you!!).
2. What was your POPLA appeal like, did it have the killer paragraphs?

If not then quickly reply and add them saying to POPLA that you need to add this info. Also have ANPR sent you their evidence pack? Anything to object to in it?!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

the appellant has advised he was not the driver of the vehicle at the time however has failed to give driver details. the appellant further advises the driver at the time displayed a blue badge. therefore it is clear, in our opinion the keeper and appellant in this case is aware of who the driver is however will not provide the information therefore liability falls on the keeper of the vehicle.
2 the second point raised is that the vehicle was displaying a valid blue badge, after a review of the photographic evidence it is clear the vehicle was neither displaying a valid permit or blue badge in this instance.
3 the third point which was raised by the appellant in the appeal to popla and please note not to ourselves, otherwise it would have been addressed earlier is that they would request a breakdown in losses. anpr hold a valid and in date contract with the landowner, our contract with the landowner is for "signs and service" and we guarantee our signs provide a 100% deterrent rate.

If POPLA accept any of that claptrap and fail to uphold your appeal which includes GPEOL, then a tenner from me to your nominated charity!

I think we can take the Lead Adjudicator's statement as a secret sign this is a slam dunk win for you. If not, then it would be an abuse of process to cut into the time allowed for you to respond to ANPR's evidence. The process is biased enough at the moment; they get 28 days to reply to your evidence; you get 7 to reply to theirs.
Since Kirbyinfurness wrote your appeal, he will have included the magic requirements to produce the contact and show GPEOL (genuine pre-estimate of loss).
As ANPR's evidence addresses neither of these points you have an easy win.
The Lead Adjudicator knows this and wants to keep his job; POPLA risk being shut down by the BPA if they don't meet their targets. The last month for them to get on track is November, and the BPA will then vote at their next meeting (presumably Dec 4) whether to give them the chop. He is therefore rushing through easy cases in order to hit the deadline.Dedicated to driving up standards in parking0 -

Yes the appeal was based on GPEOL as are all my appealsl
Trevs reply does not address it at all
So you need do nothing further!!!
