    Not a troll, I'm a long standing forum member who wants to remain anonymous as people I know read this forum.

    I spoke to him earlier, he understands I'm not happy when it comes to drugs in the house. Before I discovered the plant he seemed like an ok housemate.

    To clarify it wasn't just him who wanted to clean out the attic, other housemates wanted to as there's so much junk up there. I'm in charge of the bills, so will notice if the electric creeps up. Currently we're using just less than what we did last year! So no need to worry yet.
  • ...and the thing that strikes me about some of the replies on here are it's a little bit revealing about just who is tolerant (or possibly more than tolerant;)) of drug use. It's easy to rule out the comments that should be ignored (eg that totally unjustified one calling you a troll:cool:).

    You are perfectly entitled to be upset at someone pulling this stunt in your home. As I've said, if any of my previous lodgers had so much as hinted at drug use then they would have been out on their ear so fast their feet wouldn't have touched the ground.

    In fairness you wouldve been iable for a seperate offence of allowing drug use at you house, which is not something the OP can be held liable for

    I had my suspicions I might have been held liable for that. Hence, my strong attitude on that. If, by any chance, any lodger had been using drugs behind my back and in came the police about it I could have truthfully state that I hadn't had the faintest idea or I would have thrown them out and I would expect them to take my word for that (though, it should be obvious from one quick look at me that I wouldn't countenance any lawbreaking and I'd expect the police to realise that).

    Not sure how OP would stand on that, ie as one of a group of tenants and presumably in a younger (ie more tolerant of drugs) agegroup than middle-aged me. The average middle-aged person wont tolerant them anywhere nearby. Possibly our younger equivalent-type law-abiding etc people might do so? and therefore not get the "leeway of being believed" that we expect.

    Many years ago when studying law, there was a strong case about this. I admit the details elude me, but the basis was: LL rented out her property to four students, who smoked cannabis there, and she lived miles away. She got done for it.

    Now this was something i studied 10 years ago, and i believe the case was substantially older than that, so precedent may have changed. But at that time, lack of knowledge of the activity wasnt deemed an excuse

    The OP would be fine, as they are not the owners of the property, just fellow tenants. Thereby they have no control over occupancy.

    Oh there's much worse cases than that! But that's another thread.

    OP just to cover yourself legally, if (and its not likely) the police do investigate. State clearly, this is not your plant, not anything to do with you. answer nothing more, and ask for a solicitor if arrested.

    The police arent there to help you in cases like this, simply to get a result. You may inadvertantly land yourself in it. Askign for a soliciotr is nto admitting guilt, and the opinion of the officer isnt applicable anyway.

    So, there's a potted cannabis plant in the garden that will certainly die soon.

    Also, someone who was visiting rolled a joint and smoked it in the garden.

    A couple of you want to clear out the attic.

    Hmmmm, I don't think you have enough material here for a series......

    All this comparison with the situation involving a lodger is a red herring.

    Totally different scenario, both legally, and in terms of the relationships of the people involved.

    As for your case guest101, I'm sceptical, but willing to be convinced: hunt out the case in question.

    It's really not helpful quoting a case you have forgotten, which may not exist, from 'a long time ago', where the law might have changed.

    In what way is that useful, or interesting?

    Come on! - you have a lot to contribute to the forum, but let's keep it relevant and reliable!
