    If it was me i would be in the county court first thing Monday morning asking for a protection order.



    Court of Protection in English law is a superior court of record created under the Mental Capacity Act 2005. It has jurisdiction over the property, financial affairs and personal welfare of people who lack mental capacity to make decisions for themselves. Among its various roles the Court of Protection is responsible for determining disputes as to the registration of enduring powers of attorney, and Lasting Powers of Attorney, appointing new trustees, authorising certain gifts and making statutory wills. Examples of personal welfare issues determined by the court are decisions about where protected persons live, who they see and how they are cared for. The offices and full-time Judges of the Court of Protection were originally located at Archway Tower, Junction Road, London. Since 9 January 2012, the Court has been located in the Thomas Moore Building at the Royal Courts of Justice on the Strand, London.

    Unless you are planning to sell up and not live anywhere, I can;t see the advantage.
    If you are planning to upsize the new house will cost more.
    If you are planning to downsize your new house will cost more than it should
    If you are trying to buy your first house its almost impossible.

    Thanks so much for taking the time to provide this valuable information but I should have mentioned we're based in Scotland.I am going to speak to solicitor tommorrow to see how we can push things alongx

    Thanks foryour advice but I didn't want to take mum away from the security of her own home so soon after losing dad, my sister obviously doesn't care about mums feelings. x

    I don't think there's much sense of security in a home where you're being mentally, emotionally and financially abused and are fearful of being physically attacked if you speak out.

    Am i right in thinking you're worried about your sister having too much control over your mother, yet you're pushing to have control over her yourself?

    Hi Tony you do make a valid point however power of attorney is a legal process put in place to protect vulnerable people and is voluntary when the perspn granting it is of sound mind so it is not about control but rather protection . My sister has no legal authority in looking after mums finances or welfare .

    Hi Moji its a bit late for this as she has taken mum to her own house and basically holding her prisoner. The sooner the correct authorities deal with this the better. I suspect shes spent all of mums savings and is terrified mum signs the P.O.A therefore giving authority to check out her finances x

    The difference is that with formal power of attorney, the OP will be keeping detailed accounts of the use of Mum's money for Mum's benefit, and is answerable to the Court of Protection for her actions.

    In her current actions the sister is accountable to no one. There are suspicious that she is using Mum's money for purposes other than Mum's benefit. If this is so, Mum is being financially abused. (Even if Mum is saying sister's actions are OK, it seems that this is said under duress, so this would defnitely be financial abuse).

    So, definitely a situation that needs addressing.
