Customer Details

Just a quick question.
Can I pass on customers details such as name, address and email to other companies or would this breach the data protection act?

  • I'm fairly certain that would be a breach if your customers have not been told that their information would be passed on. There's some info about it on the ICO website here:
    http://www.ico.org.uk/complaints/handling
    It's worth noting that even if it's legally allowed, your customers are unlikely to be happy with you passing on their details!

    What if I want to warn other companies about a customer? I assume I would still need the customers permission?

    You could be nonspecific, warn the others about an experience you had with a customer from <city> who bought <goods> and <problem details>. You can describe the problem and interaction in reasonable detail, let the other suppliers draw their own conclusions and be forewarned if they see a similar pattern.

    This customer is committing fraud, they keep ordering items that have been priced lower by mistake.
  • You would still need the customer's permission, and it sounds unlikely that you'd get it in those circumstances.
    I must say I'm dying of curiosity, what did the customer do?

    ... I see you've already answered my question :) It's not actually fraud for them to do that, but I can see why that would be annoying! If they do try to commit fraud you should be able to do something.

  • halibut - it could be the way their website works, to be fair. My website (for a business that sells things :) ) has a content management system that by default publishes items as soon as you start inputting, and if you don't put the price in first there will be a few minutes (or however long it takes to write the ad) where there's a half-finished advert with a price of £0.00. Luckily our site is a catalogue one so people can't actually buy through it or I'm sure we could have similar problems.

    Then they should reappraise their hosting policy, or their content input policy. It's still not fraud. Pain in the backside, yes, but lets not accuse people of criminal activity when it isn't :)
