These forums are very helpful but unfortunately the first advice I took, ignoring the PCN, wasn't the right thing to do. Now that I have forsaken my opportunity to appeal via ParkingEye and POPLA, I really cannot see myself winning in court. I broke the rules, end of. Didnt see the massive signs, too busy going to a meeting in the services. Yes the charge is unreasonable but unless anyone on here can reassure me that that argument will win well I'm likely to be paying £165 instead. I won't look good in court having ignored the appeals process.
There are lots of people encouraging court on here but they are not the ones under pressure, and no one ever seems to post after they have won a case, each thread ends without conclusion. It seems that people probably are paying at the last minute, and ParkingEye are following through. I don't dare risk waiting for court papers to drop. I have no defence. I've written to the services, I've written an acknowledgment. No one can tell me exactly how likely I am to go to court and I can't cope with the stress.

You can pay or you can take the advice of the excellent forum members like Coupon Mad and beat this mob.
I have had about 8 of their dodgy invoices through the door addressed to me as the registered keeper. Have the drivers paid a penny? Nope. And neither will you if you remember that they are trying to persuade you (successfully at the moment) into believing that they have a legal right to YOUR money.0 -
No one has ever recommended going to court. Court is an option if the PPC serves papers and you wish to defend.
No one has ever given guarantees about court outcome. It is Russian Roulette, depending how knowledgeable the judge is, how your defence has been constructed and how you conduct your case there.
But don't forget, it is the Small Claims Court, no wigs, gowns, docks or death sentences, just all sat around a table to discuss the issues. Yes stressful if you've not done it before or you are uncertain of your facts.
The £165 is unlikely to be much higher if the court found against you (they can't go adding on huge PPC solicitor fees), but ultimately it's up to you to decide. No one on here will cast any judgment on you should you decide to pay up.
But, I do detect a hint of criticism of the forum in your post; the advice we give is best advice at the time. Ignore was by far the best way of dealing with most PCNs until recently and the game changed when PE became rabidly litigious. Can you direct me to the thread you posted at the time you were given the 'ignore' advice please?
EDIT - I've just noticed you've only got 2 posts to your name, and both on this thread, so you couldn't have taken any personal advice from here, so you've no grounds for any beefing about the forum. Have they been recent? The court activity seems to have picked up in the last couple of months. The letters from them follow a plan, despite my replies being exactly in line with our expert forum friends' advice: Acknowledgement has been sent, but Response will be pathetic as I have no defence in court, the signs are there, the landowner supports PE. PE mean business, and I'm a soft target as I didn't appeal.0

I'm very grateful for people sharing advice it has been a lifesaver. There's a lot of clamouring about how it's an unenforcable penalty and I allowed myself to be misled, angry at myself, also angry that I will lose £100, but its my own fault! Thanks0

You don't say who the landowner is, you don't say who the retailer is, you don't say whether your notice to keeper arrived promptly, you don't say a lot, so we can't help a lot. So if you are going to pay them without a fight then I'm going to be blunt here, go and pay them as its pointless you being here.
And by the way if the first advice you took was so wrong, where was that? When was that? And how did you get advice when you joined the forum on the 03/08/13When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

If you are intent on paying money for an unenforceable penalty, then why not give it to charity instead?
We are here to advise people about what in all intents and purpose is a scam.
We can't force people who are scared, ignorant or just plain stupid into feeding the con, no more than we can advise a set of rattled PPC who see us as a threat enough to watch and SPAM the forum.
