    Sorry I haven't managed to get on, life has got in the way again!!


    I am still concerned that your ex thinks the council will rehouse him, unless you live in a very rural area most councils have a huge waiting list for 1 bedroom properties.
    Not sure how your local council works but in most areas of the country there is a website that you have to join and people have to register and then they show interest in properties they would like to live in and the top person (longest on the list, highest priority) gets the property.


    Anyway enough about your ex because we are here to support you.


    The court forms are very easy to complete - it's all done online now https://www.gov.uk/possession-claim-online-recover-property
    The cost is £250 which you will have to pay and then try to reclaim.


    Once you get a hearing - usually 4-6 weeks - you get to see a judge and he will make an outright possession order for you to have your property back in 14 or 28 days (depends if you go for accelerated or standard possession).
    After the 14 or 28 days has expired your ex should leave, if he doesn't you then have to instruct bailiffs to remove him. This will obviously cost money and will take a few weeks.


    If you are not comfortable doing this then I agree you should speak to a solicitor and pay them to do this if it will give you peace of mind.

  • Maybe this is a daft question but will it not make it harder to have him evicted if he can demonstrate that your son now lives with him?

    A child is only counted in the household for which an adult receives Child Benefit so I would guess that Skinny gets the Child Benefit.

  • I'm sure you're both right. He retired this week and is 68, so I don't know if that'll make any difference. Yes DS is 16, but I'm not evicting him!

    And the end of the day it's his problem to find somewhere, and not my responsibility, we've been divorced 13 years, although I appreciate he's in a difficult position so I'm not going to make life more difficult, he's the father of my kids and a good one. He has also worked full time since he was 14 and has never claimed a penny in benefits. All he wants is affordable housing, he's not asking for handouts. Makes my blood boil when I see these programs about youngsters perfectly capable of working, but just living on tax payers money, don't get me started :mad:

    Although I will be effectively making my self homeless while he lives in my house, but it suits me to do that if I can make a bit extra £££! Quite looking forward to it in a strange way actually!

    If he is 68 it might make a small amount of difference as older persons have higher priority than younger people but there will still be the issue of available properties.


    I reckon he will have to look at sheltered accommodation as the quickest route in to housing.


    In our area we have a central website for all properties but also a lot of Housing Associations have their own waiting list for sheltered so it would be worth contacting them.


    Sheltered is not for people who need care although they usually have pull cords in the main rooms in case people do need help - would your ex consider this?


    I totally agree it is not your problem what your ex does - I think you have been very generous to let him have your house to live in while you have had to rent elsewhere.

    Sorry to keep posting but thought I would comment on this - many years ago judges in the county court would rarely evict families but nowadays they do it all the time.


    People who private rent have no protection at all from being evicted as long as the landlord follows all the correct procedures - this includes families, elderly and disabled.


    It is then up to each Local Authority to assess their situation and see whether they can be provided with temporary accommodation.


    People are routinely evicted from social housing (council and housing association) although too be fair they have a lot of protection and are usually in court numerous times before they actually get evicted.
    You know things are bad when someone is evicted from social housing as it is quite difficult to do - it usually means they have had loads of chances to prove themselves and haven't done it.

    Thank you all for your comments, and ee for the links & info, very useful. He's been on all the lists, council and social housing for about 4 years, so it's just a change of circumstances.

    Anyway, I don't need to worry about that just yet.

    Quite alot done today, bathroom very clean. I got some drain cleaner for the sink and now it leaks into the cupboard underneath :mad: Rang the landlord and he's coming Monday, so at least I don't have to pay for that. Will all change when I move!!

    For some reason there was a random raw beetroot in the middle of the road this morning, so I picked it up, cooked and roasted it for tea, free and lovely.

    Did spend £12 in Sbobs on drain cleaner, room freshener and some other bits, using my discounted gift card gave my 6% off and nectar points.

    Took DS to his waitering job this evening, he looked very smart in a bow tie.

    Meter readings taken and entered on the Coop website. They've just started online account management and it's the first readings I've done, so no idea yet if I'm on track with my utility bills.

    Also made a heap of videos today and going to so some more tomorrow to boost my online earnings. So better get an early night :A

    Picked DS & friend up from waitering job today (they camped in the grounds of the manor overnight!) It sounds like an awesome night, They got paid £11 an hour for serving champers and canapes. Guests brought their own drink too and the pair found a spare fridge in the kitchen and charged guests for keeping their beer safe and cool made and extra £50 from this lol.
    On the way back there was a really pretty bird with a very cute and fluffy offspring in tow crossing the road. They had just safely reached the other side when mummy decided to double back right infront of me, the result of which was a sickening bump. To which DS yells, "YAY you got it"
    In my rear view mirror I could see a twitching pile of feathers in the middle of the road, with small cute fluffy thing looking on forlornly. I was gutted, really gutted. DS's friend pipes up, "if you're that up set you should go back and run over the baby, then it won't be sad any more." :(

    Any way aside from that my ebay bids are up to £32.50, and I've had a very interesting chat with some-one about a scheme called matched betting. Which I'm not going to advocate or post any links too because of it's very nature, but I did make £13 from it today and I'm interested to see how much more I can make (scratches chin thoughtfully)

    DD phoned (I always know she's wanting money when she phones!) any way £70 transferred which secures her next 3 weeks rent, food and antibiotics for her infection. I think I need another savings pot for DDs emergency fund!

    Health side, I biked 23 miles with some friends and it wasn't my turn to buy the coffee :D. Walked my guest dog several times and uploaded a few more videos. So a very good weekend, unfortunately I have to go to work tomorrow!
