soolin I am reffering to if the buyer tries to force a refund via ebay dispute.

even tho 98% of my activity on ebay is buying, I think ebay is too pro buyer protection. The only thing I agree with is their process for handling non delivery of goods and protection for that, the rest is overboard especially the 5 star system which is used to ban sellers, and the policy on p&p costs.

I quoted the law in another thread and I cant be bothered to look for the exact legislation again right now.

A classified site or advertiser cannot enforce delivery costs. Since bad ratings on ebay can lead to suspension or banning that is in affect enforcement and as such potentially illegal. They certianly cannot legally force a postage fee refund (even partial), if the postage has been carried within the terms of sale.

Buyer on this thread is NOT using any form of dispute to force a refund though. there is no formal mechanism on eBay to open a dispute on basis of postage.

It entirely depends on the legal definition of postage, if you charge £7, and it actually costs £4 then it could be held that as a buyer you have agreed to the actual cost not the advertised costs.

I think you are getting muddled.

eBay are not enforcing postage costs they are only allowing buyers to rate sellers against each other on the basis of what buyers perceive . There is no enforcement here, buyer sees postage and pays it or not..where are eBay going round and insisting they buy the goods?

and ratings alone is fine, but it isnt just that, you have even made a thread stating what happens if you get low ratings.

I am confused by your opinions, you are a seller, yet it appears you condone the bad treatment of sellers and their right to charge what they want.

I do have my worries about stars and feedback, but I am not naive enough to believe I have a remedy under law if I get marked down for anything. I started the dashboard thread purely because I do have worries and don't believe all sellers are aware of the issues.
