    Quick question for the masses...

    I am sure this will be cancelled before POPLA make any decision.

    BUT, is it worth solely appealing on the EA or should everything be included.

    I dont believe we have had a POPLA victory on the EA (Even mine was ruled on an incorrect ticket, which was the "Easy Win")

    You should in theory be able to appeal to POPLA on a well-worded EA argument alone - but for a vulnerable poster I wouldn't recommend it. Better that he sends a POPLA appeal like yours, trubster, and rattles the managing agent's cage again because this treatment of disabled people is inexcusable!

    I am preparing the POPLA appeal and LBA for the OP, that is why I asked, I would have made the strongest possible POPLA appeal based on case laws etc. only involving the EA

    (Especially as a POPLA loss is not the end of the world as the MA/LO etc. will ENSURE this is cancelled before it gets anywhere near a court room as a counterclaim would follow :D)

    Here's a recent POPLA appeal with that point as #1 in the appeal:

    As you can see I now also talk about breach of the statutory (became law in April 2011) 'EHRC Code of Practice for Service Providers', re the Equality Act 2010 - and how this would be 'indirect discrimination' by applying a blanket policy which causes unlawful detriment to a certain group of disabled people (i.e. anyone without a Blue badge who is then harassed for parking where the law allows them to, using the reasonable adjustment they are entitled to use).

    You'd need to be very, very clear with the POPLA assessors that the Equality Act specifically states that a blanket contractual term, if causing discrimination like this, is specifically declared 'unenforceable' by the Act. So in law the PPC's charge and their the signs mean nothing if they cause indirect disability discrimination.

    I expect you also saw grunwald's court win on pepipoo, after a POPLA loss? He's quoted his court case number as well so others can cite it in POPLA and court defences.

    Did you use the word scam? They don't like that on pepipoo, maybe it was just a word. I had that happen to me once for that reason on pepipoo, I had forgotten about it as it was well over 2 years ago! They released the chains within a week.

    Yep, saw the court ruling. Not read the transcript (if its even out there.)

    Nope, I did put a mild response to the "Advertising Ethics" post on the Flame Pit... all I said is "I block ads" and within seconds it had GONE!!! Followed with 2 further posts asking where my original post had gone. Sent a PM to Fredd and had no response...

    Maybe they dont like people who block ads?

    I dont agree with google/facebook tracking my every click as well as being bombarded with adverts for everything and anything online.
