PCM Meadowhall Blue badge expired

Wife is disabled. Had a lot to cope with lately (friend died) and forgot to renew blue badge. Didn't realise until we got a penalty notice at Meadowhall. Havent checked the photographic evidence (in case it asks for proof of name/address etc) but suspect it may be a photo of the blue bade showing expired date. Wife will shortly be renewing. Fined reduced to £57 for 14 days, £95 thereafter. I realise this is different to other posters who fail to display or BB fallen off dash, as there is probably strong evidence the BB has expired.

Not yet done anything. Wife is wondering if we should pay as the BB clearly had expired, or whether the BB is irrelevant. Realise there is loads of threads to go through but struggling to find some about expired badges.

What should we do?

    Pcm have got a track record of this. Someone on pepipoo got a payout after threatening to sue them for a breach of the equality act.

    Do a simple appeal to pcm to get the popla code. Put what you like. When it gets declined come bk to us.

    Can you do a search on "Blue Badge" over the last 7 days and you should find it.

    Also, was the car registered to a disabled person, with a disability exempt tax disc? If not, it doesn't matter, but if it is, that is just as strong evidence of disability as the blue badge, for these purposes.

    Please realise that the blue badge scheme does not apply to private land, this is for public car parks run by councils, and on street parking only. Check your handbook that it came with.

    Also this is an Equality Act 2010 breach, the disability doesn't disappear with an expiry of a badge, and if you as mentioned have a zero rated tax disc then quite clearly a reasonable adjustment has not been made, which is illegal.

    Please make a complaint to the retail park along the lines of this, tell them you are minded to sue them and their agents for their illegal actions, head it like this

    Sorry, just a pernickity point - what they have done it is 'unlawful' (ie breach of civil law) rather than 'illegal' (ie a criminal act).

    Thanks everyone. Not done anything yet - buried my head in the sand as it seems i am going to get a lot of grief before it is sorted, and i struggle with writing letters etc.

    So, i need to appeal to pcm - must i do it in the 28 days they mention or do i wait until they get my details from dvla and then respon. Presumably appealing will give them all the details that they do not have yet?

    If they haven't sent a Notice to Keeper yet (in the post), and you just have the Notice to Driver (ticket on the windscreen), then yes, wait for the Notice to Keeper, as they are never quite correct when it comes to conformance to the Protection of Freedoms Act (which gives you more ammunition). But ONLY if YOU are the registered keeper. If it's a company/hire/lease/motability car, i.e. someone else is the registered keeper, then appeal now.

    Waiting for the NtK also costs them £2.50 DVLA fee - what a shame.

    If you haven't got a Notice to Keeper by post yet, spend the time usefully. Register on pepipoo and send a pm to trubster for a bit of coaching about how to get this cancelled. Please contact him if you are feeling vulnerable about it all, he knows how to beat these chancers & I expect he will help:

    He won at POPLA and then complained so much he got compensation out of Meadowhall!

    Next time he got another fake PCN there they cancelled it as soon as they saw it was him!

  • Got my notice to keeper - says date this notice is given is 3/9/13 and I have 28 days to respond. so I have been slow in acting. I have appealed via their website (due to almost being at 28 days), but have a copy of the text I entered. Do I need to follow it with a letter copy? Are there consequences of missing the 28 day deadline?
