    Oh yes those faulty valves are a !!!!!! <-- that's not what I wrote :silenced:. Unfortunately for Jet2 the judgment in Wallentin-Hermann sets out that exceptional circumstances are not established by most technical issues, which are largely routine given the degree of technological sophistication of aircraft. The exceptions cited by the ECJ, for example, are a manufacturer's warning of safety issues in a particular fleet, sabotage or terrorism.

    Time to sue (if it arrived 3+ hours late)

    You will see a letter that Centipede worded for us. Post #59 We had the flight safety blurb. We have now written, asking for confirmation of exactly what the problem was.
    Loved our trip to the West Coast USA. Death Valley is the place to go!

    Everyone check on their home insurance policy too. I just realised I had legal cover tacked on to mine which means I get a solicitor to take this on for me and cover all expenses if Thomas Cook want to play hardball. Bring it on! :-)

    Just wondering if anyone else reading this forum was on flight TCX 879 K on 7th Aug 2010 LGW - Izmir Turkey, arriving 7 hours late.
    Would be great to hear from you and know how your getting on with you claim, reasons given etc




  • me my wife who was 7 month pregnant and my 6 year old were delayed for just under 6 hours at palma airport , we were flying with jet 2. I aplied for compensation and the repley i got back was.



    that jet 2 are a non refundable airlne and regrettably,we are unable to refund the cost of the flights which was already flowen. as the delay was over 5 hours,the custonmer informtion bullitongave the option torecive a full refund for customers not to fly,how ever you flew on the flight so we cant offer a refund.



    as for compensation under reg261/2004o on investegation extraodinary circumstances led to the delay of your flight.as the delay was caused by an unexpected flight safty shortcoming consequently there is no entitlement.



    the reason we got at the time was that the portable stairecase crashed into the side of the plain causing it to need fixing,but jet 2 would of got compensated off the airport for thousnds and we only got £8 lunch voucher



    #any one else had the same problem of any advise thanks

    Jet2 are a non-refundable airline?! Excuse me? That's a classic! If you can get them to repeat that hilarious "defence" to a judge, you could sell tickets online - I'd buy one! :rotfl:

    Air Transat TS 249 - 29 June 2012

    Just wondered if anyone was on this Manchester to Toronto flight.

    FlightStats says landing was delayed 4 hours 22 mins, but Air Transat only admit to a 3 hour 55 min delay - which halves the compensation. (At least they're not claiming extraordinary circs. - so we will get a big chunk of money back.)

    I can get departure info from Manchester (really helpful staff), but all the Canadian organisations (Pearson/NAV CANADA and the Canadian Transportation Agency) find reasons for not giving arrival info.

    Any suggestions anyone, please.

  • Hi, When we were stranded for 2 days due to the strike in 2010. We tried to claim from Ryanair but they denied responsibility . With the latest ruling from the EU, we would like to claim expenses. unfortunately we had a clear out recently and threw all the receipts away. We got a relative to put £500 in our bank account and we drew out cash to pay for our hotel ,taxis to and from the airport and food.
    Do we have a chance of getting anything back ? Also what is the difference between Ash clouds and strikes, they are both beyond the control of Ryanair. Regards Johnboy
  • Strikes are like technical faults. They can be regarded as beyond the control but are not necessarily. I would expect that a strike by Ryanair staff is in their control. A strike by a supplier (like an airport) would be up for debate.
