Result!! Today I received an e-mail from WizzAir offering €400 each for our delayed flight. Myself, my partner and our daughter were delayed at Luton in summer 2011 for our flight to Kiev.
I based an e-mail to WizzAir on the MSE letter template and received an immediate response saying that my claim would not be honoured as the delay wasn't the fault of the airline. I replied around a month ago asking for the exact reason for the delay. I was contemplating my next steps when the e-mail arrived today saying "Since the flight delay was not caused by extraordinary circumstances and it was departed with a 3-hour and 10-minute delay, we decided to pay the compensation of 400 EUR/passenger."
I'm unsure exactly how late our arrival was and I am aware 10 minutes can easily be made up on a 3.5 hr flight - it may well have been on this occasion, but will I point this out to them?? NO!!
Richardw wrote a few pages pack "Tenacity and perseverance is very important when pursuing compensation claims against airlines" and now I fully believe that. If I hadn't responded to that initial knock-back I doubt I'd be sat here awaiting a £1k payout.
Thank you so much to MSE, Centipede, Richardw and other mainstays of this forum. Hopefully results like this will increase the determination of others because I know when I read of positive results on here they did that to me.

As you'll see from my earlier posts - I submitted my initial claim to BA on 1st November (2 seperate claims for 2 seperate flights).
Like you I have had no acknowledgement or follow up.
They were chased up on the 26th November (after the intial 14 day time to settle).
Knowing they were backed up I held off doing anything during December.
I have issued an LBA inviting them to settle within 28 days and this was signed-for on Monday. I also e-mailed them with the chase-up.
I did want to hold off filing my LBA but felt after over 9 weeks of waiting with not even an acknowledgement I needed to show that I still exist and am still claiming the compensation due to me.
Obviously I would rather hold off going to court (living in Scotland, the small claims procedure is a bit more complicated than England's MCOL..it's also quite expensive due to the level of compensation owed). I believe BA will do the right thing in the end (hopefully they will as I'm looking to book flights in August with them and could do with the money...) and so I'm now happy to wait out my 28 days (even extend to 28 working days) for a response from them before heading down to my local court house.
I feel your pain. When I spoke to Customer Relations today I basically told them that by ignoring my letter and not providing me with any information about my claim, they were giving me no option but to consider legal action. When they remonstrated I asked them very specifically what other option I had than to sit and wait until they could be bothered to respond. They of course could not answer, so again I stated that this situation was forcing me to give notice of court proceedings.
Separately, I sent a couple of tweets to the British Airways Twitter account effectively saying the same thing. I got a response asking for my claim number, and behold, within an hour there was an email in my inbox confirming that I was entitled to compensation and that they'd be sending a cheque shortly. Hurrah.
Personally, I actually feel that the ruling is pretty unfair. They have had to pay me more than I paid for the tickets, which is surely not sustainable for any business. The only hope is that it makes them make decisions to re-route more carefully in future and ignore engineering warnings at their peril.0 -

Kiev Borispol to Dusseldorf (LH3005)
*I was then meant to have a connection flight at 18:30 from Dusseldorf to Heathrow which was cancelled (LH3386)*
I was then scheduled on to a different flight which was LH3388 which was scheduled to leave Dusseldord at 20:50 but I think this was delayed further and believe I got in to London much later than I was meant to on the cancelled flight.

So Flybe are telling me that the reason for the delayed flight of four hours is that a hydraulics failure mean the plane had to divert "en-route" to the airport I was taking it from. And they state that this is considered an "extraordinary circumstance."
True?

Last August we flew with Etihad. We booked tickets with them from London to Koh Samui (all Etihad flights). The outbound flight consisted of 3 flights. London - Abu Dhabi, Abu Dhabi - Bangkok, Bangkok to Koh Samui. The first flight left and arrived on time. There was a one hour delay on the second flight leaving Abu Dhabi which resulted in us missing our connection in Bangkok. We finally arrived in Koh Samui eleven and a half hours later than scheduled! Etihad is saying that they won't pay compensation as the delayed leg of the trip originated outside of the EU. My argument is that we booked one ticket from London to Koh Samui not 3 separate tickets. Therefore our flight originated within the EU and arrived at its final destination eleven and a half hours later. Anyone got advice on where I stand with this?

Just to be clear on this. Although you can indeed book it right through with Etihad, they do not fly to Koh Samui.
The Bangkok - Samui sector is operated by Bangkok Airways.
They own and operate Samui airport. For 20 years they would not allow any other operators to use it, however since 2008 Thai Airways also fly there.0 -

Success Story - As per post 4671
After offering to drop the interest charges, Cathay Pacific agreed to pay the compensation and the £60 court fee
I just have to sign a "Release and Discharge" document, send my bank details, and I should receive the payment within 3-4 weeks
Getting a total of £564 so very happy indeed!

I am at a point where I have sent the 1st letter to Thomas Cook Airlines and I received a letter back stating that they would respond within 28 Days. 28 Days has long passed and as I have waited a reasonable amount of time since Christmas & New has passed, should I follow up with the Claim on hold letter or escalate to CAA?

I just wanted to share my success with Easyjet in getting 800 euros compensation for a delayed flight from London to Dubrovnik in 2010. I followed a letter up with a call and they agreed straightaway that I was eligible for compensation. I've just had £630 back from them, which was more than the original flights cost! :j

Thanks. The Bangkok - Samui leg did have an Etihad flight number though. It was a codesgare with Bangkok Airways. Does this make any difference.
