  • Hi! I'm wondering if we can get compensation for a cancelled flight? It was approx 3-4 years ago. My husband and I were due to fly from Birmingham to Belfast. When we turned up at Birmingham Airport we were told that the flight had been cancelled due to snow and , because it was an 'act of God', we could not get any compensation. (The strange thing was that other flights were arriving and departing from Birmingham.) Airline staff were so unhelpful and basically weren't interested
    Our flight was rescheduled for the following morning, however we had to stay overnight in an airport hotel , at our own expense.
  • At face value you seem to have a valid claim. Register (free) on flightstats before searching for flights on the date and route you were originally due to travel (IBZ to BHX).


    Thanks Centipede100, could you answer just one further query, it turns out that the flight was in the end cancelled. (even though we flew to another airport via the same carrier prior to this cancellation) Do I fall under delay? Or Cancellation? Thanks again advance.

    If snow was the real reason for the cancellation (which may have been Belfast rather than Birmingham) then they are correct that no 'compensation' was due, however the airline has a duty of care in situations like this and was responsible for your hotel and food costs. If you still have the receipts you should forward copies of these for reimbursement

    I would say No (My opnion ) as BA did their duty of care and (hopefully) got you back to UK on the first flight available

    IMHO you need to claim from your Travel insurance
    I would have gone back to school if I had wanted someone to treat me like a child and correct my wording. No I am not looking for my wife's loss of earnings. What I am asking is, BA did nothing other than say fend for yourselves and we will reimburse the costs. Well they haven't and are offering a lot less than promised. I expected some genuine professional advice not the sarcastic response I got.

    Does anyone know before I do a letter. I went on a package holiday and the return flight was delayed 23 hours back to the UK. They also put us on a short haul plane not suitbale for a 9.5hour flight can they do this?
    Am I likely to get anything and I am assuming from previous messages I write direct to Thomson?

  • Just curious as to whether anyone else has suffered under similar circumstances.

    We had a mechanical failure on the plane. The airline sought to fix it but kept us holding on until it was too late. The plane had been on the tarmac too long and the flight was cancelled. Poor management decisions were made meaning if they had rescheduled us on other flights we could have reached our destination.... however cancelled it was... and so we got another flight, same company, but the next day free of charge.

    Hotel and food was provided.

    We didn't panic, as we both have insurance and were assured the airline would compensate us. They did not have the part on site, it was all poorly prepared for in such an eventuality.

    HOWEVER

    upon returning both insurance and the airline have refused to compensate for a missed days holiday, a missed hotel stay and the costs incurred for a new day in new york.

    The insurers received a letter from the airline stating 'staffing legalities'' (incorrect) and refused any more. They haven't commented on the lost hotel stay or the extra days expenses (we wanted 2 nights in new york so booked another day last minute)- i'm still awaiting a further response.

    The airline has offered $300 per passenger compensation. Though i have refused it (it doesn't help me, as 1- it no where near covers the cost of a uk-ny flight, 2-why would i want to fly with them again 3- i'm still £275 out of pocket for hotel...vouchers with them won't solve that). I politely declined and quoted the ECC to them with the 600 euros thing (and what they had written on a sheet at their info desk, But they are claiming that they have taken all the necessary legal matters...how is this so as in theory, if its their fault, at no point should i be out of pocket. I don't mind not getting compensation for the lost day now, i just want my out of pocket expenses covered as i budgeted for my holiday and its THEIR fault that i didn't receive what i paid for

  • We (4 pax) travelled NCL to Gran Canaria in the summer with Thomas Cook and were delayed 5 hours due to technical problems, faulty door. I wrote to them using the template letter (before the ruling) and initially got a rejection letter. I sent another letter and have received a further rejection letter due to the technical fault being 'extraordinary circumstances'. Do I have grounds to take this further or is this the end of the line?
    If I can take this further, should it be by letter or do I need legal advice?

    Sorry - but why are you expecting genuine professional advice from an online forum? I think you'll probably need to pay for that.

    My (non professional) opinion is that BA have met most of your costs, and that the remainder ought to be covered by any half-decent travel insurance policy. I'm sorry that the trip to New York was ruined by Hurricane Sandy - that's really bad luck. But if you'd traveled with an American carrier, you'd have got nothing at all, I think. So claim on your policy!
