  • I was delayed 12hrs in Sept 2009 flying from Bodrum to Bristol with Saga airlines , I have managed to get the flight number and the dates but I do not have copies of the tickets etc and I booked through Goldtrail who have since ceased operating. What I do have is the letter given to us at the airport for delayed flights. I have checked the flight stats website and surprise surprise there isn't any info shown for this delayed flight. On top of all that SAGA are a Turkish owned airline so i still don't know if I can claim and if I can where do I go from here ??? Help anyone please

I contacted the CAA as I believe Monarch are stretching the extraordinary circumstances provision as listed under section 4 of their claim form and using the CAA 'name' as confirmation and support of their stance ...... see Monarch claim form here .... https://www.dropbox.com/s/fimcgnqennoear1/EU%20Compensation%20Claim%20Form%20for%20a%20Delayed%20flight%20%281%29.pdf

I copied this claim form to the CAA however whilst they said they were very concerned and they would look into the matter they claimed they could not down load the above. Is there another electronic way of getting this to them or are they making an excuse?

    TIA

You could upload the document to a free photo sharing site such as Imageshack or Photobucket?
Or of course just take a screenshot of the claim form and include it in the email.
If you are using Vista, open your apps and search/select 'snipping tool', which is an easy peasy way of taking a screenshot of an open web page.

Yeah, I know, but you know what I mean?

You appear to mean that you think the CAA and the dutch equivalent should help every single passenger that has been delayed and seeks compensation going back to 2005?
I think it's an impossible ask Dopey.
Although you have my sympathies etc etc ;)

Thanks Centipede for the help... ok so although we had already paid for a taxi that was missed due to their delay and had to get on ourselves we cannot claim that?

I also think Centipede is right, but IMO this is wrong as well. Morally I mean. The financial knock on effect of delays runs deeper than the compo issue, if you are unlucky enough you could have to pay for nights in a hotel that you didn't take, or extra days in the airport car park, missing days at work/important schedules etc etc. There's a host of add ons.
Travel insurance ought to be better than it currently is in these respects IMO

Hi everyone I got the generic email from Monarch this morning.

    Hello, thanks for your email.

Firstly let me apologise for the time it has taken to reply to your email, as you can imagine we have had thousands of claims regarding compensation, and we are doing our best to look at each passengers claims on an individual basis.

As the court case was only passed recently, we have only just got the team and process in place to deal with each passengers claims. We are working as fast as possible and will respond to your claim as soon as possible. Unfortunately I cannot give you an exact time of when we will have your claim processed, as each claim has many factors which we have to research in order to make the judgement regarding the compensation.

    Kind Regards

Turkey is not part of the EU, so I don't think that this ruling will help you.
  • If anyone can help regarding the flight delays i would really appreciate it!
we have just arrived on holiday after a 30 hour flight delay. it was a package holiday with Thomas cook and we were due to leave gatwick for Cancun. apart from being a complete nightmare with TC not telling us anything at all, and only giving us a £6 food voucher at the airport we asked about cancelling adn were told no, we would loose all our money. we asked about compensation and they said go through our insurance company.
It would appear at first look on here that we should be entitled to the full compensation, but our reps says it doesn't cover charter flights? if anyone has had a similar circumstance and could advise??
    package = 30 hours delay = ??compensation??
    thanks
  • Hi. Any advice? Our flight from Kefalonia was delayed I think for over 4 hours on 26/06/2011. I can't find the details on Flightstats. It is not listed. I know we flew out with Tor Air following Olympics quarrel with Monarch but cannot remember who we fle back with!

Nothing on the Aviation Herald on 08.08.12 to say Wizz had a bird strike. However in my opinion a bird strike (unless very severe) is not an extraordinary circumstance as they happen every day. If it was a severe strike then blades would require replacement but again, in effect, this is a technical problem.

I love the comment ......... their initial refusal for compensation was that they did not agree with EC Regulation 261/2004 articles 6 and 7.

they seem to still be resisting the ruling even following the 23 October decision...is this possible?!

    "..Dear mr. xxxx,

    Thank you for your answer.

Please be informed that the wording of the Regulation reflects the intents of the European Commission as the legislative body: the compensation set out in Article 7 is only due to the passengers whose flights are cancelled (if the reason of the cancellation is not an extraordinary circumstance), and not to passengers whose flights are delayed – irrespectively of the reason and the length of the delay.

The official documents form the Operational Department about the delay can be issued only for the Authorities. This means that Wizz Air refuses to issue the official documents about the birdstrike event to you. Thank you for your kind understanding.

Thank you for your time and consideration.

    Yours sincerely,

    Customer Relations Department..."

How odd they have already confirmed they have received everything!! ont he 2/11/2012 and some 3 weeks later claim this!!!...

It was sent they lost it, which IMHO is extremely serious, a passport page with numbers and pictures!!! nice to know they are careful and diligent!!!...

    County court paperwork dispatched...

for anyone who is going to make a claim here is the link to the site...you can fill the form in all typed up and print it off...

    http://hmctsformfinder.justice.gov.uk/HMCTS/GetForm.do?court_forms_id=338

I have to say I am totally disgusted with Monarchs tactics and will never use them again..whilst its kind of them to offer an additional 25 euros if you accept the compensation as their travel vouchers and the thought did cross my mind till I compared the holiday and found with Monarch it was £1,383 and with another operator £982!!!! ..

    will keep you posted....
