    We do seem to have been lucky on the outbound compensation compared to others - resort rep was on the hotel phone to us early next morning and an equal value trip (Pirates) to the day lost was agreed and taken during the holiday. We were the only ones at that particular hotel from the outbound flight. Sorry to hear you didn't even get an apology from your resort rep - ours was very pro-active and apologetic.

    Have you received a letter regarding the outbound delay?

    Is that Thomson's response to both flights or just the outbound one? Am going through our hols insurance for the return flight and that will cover the additional incurred expenses.

    I think chasing Thomson's direct sounds like a long fight with the Sturgeon case on hold, though be interesting to see if they state 'exceptional circumstances' for both flights with a very similar issue and worth putting something in writing to them.

    PM me if you like - we probably spoke at the airport or on the plane - there were 4 parties on both flights that I was aware of.

    With reference to Article 7 of Ec 261/2004 compensation, there is currently a bit of a stay to the Sturgeon Judgement, BTW Thomson being one of the companies that fought against the Sturgeon Judgement, so it may be best to wait until there is a bit of an update on the Sturgeon judgement which is expected next year.

    Even if there is a development and claims for compensation for over 3 hours delay can be regarded as cancellations, Thomson will doubt argue that the delays were due to Extraordinary Circumstances and could not be avoided despite reasonable measures and that the Wallentin Hermann case does not apply in these situations.

    If you currently have Home Insurance that has legal expenses cover, this may assist you in the future.

    They met the standard of care requirements for both flights (irrespective of the amounts not covering 2 coffees, a croissant and a muffin!) and we did lose the first day of the holiday (this was acknowledged by the rep in resort).

    As in my previous post to another on these flights, I will go through our holiday insurance for now.

    Thanks for the tip regarding legal on house insurance and we do have this on our current policy.

  • Hello,
    We are booked on a Jet2 flight to Dalaman tomorrow (9/9/11), at 14:10, just a text message from Jet2 saying that the flight departure will now be 19:35. So instead of arriving at a reasonable hour we will be arriving in the early hours of saturday morning. Will now have to contact the car hire company and car parking company to rearrange with them. Even though we have been forwarned are we entitled to any compensation for this?
    I would appreciate any comments. Is there a time limit on claims, if we are eligble?

    Thanks for that. Even though we have been given about 18 hours notice by Jet2 would we still be able to make a claim?

    I believe you can make a claim if you were given less than two weeks notice of a cancellation, but not sure how it applies to delays, nor whether a rescheduling equates to a delay

  • My father's return flight from Majorca on Thomson airways this weekend was delayed by 4 hours, meaning that when he returned there were no longer any trains running to get him back home & so he had to book a hotel for the night?

    I don't know how compensation for flights works, but do you think he's entitled to something because of the extra costs incurred?

    Also, shoudln't they have given him a voucher or something to buy a drink at least at the airport when he was waiting?

    He checked in as normal & was told that the flight was all ok but he ended up being delayed by several hours & then the flight was detoured to Ibiza to pick up some passengers there. The plane was changed to a larger plane to accommodate the extra passengers but the seat allocation for everybody implied that Thomson knew about this change when my father checked in. Surely he should have been told at checkin - over 2 hours before the scheduled departure - that the plane was delayed?

    Any advice would be appreciated.
