    So Mr Figgin and I are booked in for next Friday morning (16/08/13). Apparently we'll pay the fee, see the judge then go to OR office for the interview all in the same morning. Gets it all over with I suppose!

  • hi all i went bankrupt on the 9th august and ave my interview on the 29th as they on anual leave fees good to be free of debt

    I shall let you know how i get on just a quick question if any other debts turn up in meantime can i add these on to the bankruptcy as i dont know if thats allowed

    All Qualifying debts (the ones that are not student loans etc) are included regardless of if they are on the SOA (6.28) or not.

    Will all my debts be included in my bankruptcy?

    If you are made bankrupt, you must stop making payments directly to your creditors. Your creditors must make a claim to your trustee (that is, either the official receiver or an insolvency practitioner). They should not ask you directly for payment; if you receive any requests, you should pass them immediately to your trustee to deal with and tell the creditor that you are bankrupt. There are some very limited exceptions to this non-payment rule. These are:


    • secured creditors, such as creditors who have a mortgage or charge on your home. If mortgage payments are not made, the lender may sell your home.
    • non-provable debts, such as court fines and other obligations arising under an order made in family proceedings or under a maintenance assessment made under the Child Support Act 1991. Non-provable debts are not included in the bankruptcy proceedings and you are still responsible for paying off such debts;
    • benefit overpayments, where the benefit provider can recover any benefit overpayments from further benefits you receive until you are discharged, when you will usually be released from these debts; and
    • student loans.


    The official receiver, or trustee, dealing with your bankruptcy will write to all your creditors to tell them you are bankrupt. Your creditors can then register a formal claim in your bankruptcy, by sending notice of your debt to the official receiver or trustee.



    Not all of your debts can be included in your bankruptcy, these are known as non-provable debts and you will be responsible for continuing to pay them. These include CSA assessments, fines and maintenance and any obligation under a confiscation order made under section 1 of the Drug Trafficking Offences Act 1986, or section 71 of the Criminal Justice Act 1988 or under Parts 2, 3 or 4 of the Proceeds of Crime Act 2002.
    Your OR phone call is nothing to worry about, its just for the OR to get a feel why you went BR. Before the call just look through your 6.28/SOA so your familiar with what you have said. The OR will just go through your 6.28/SOA with you. Also before the call have a big mug of tea ready or a bottle of water, and while they are writing things down you can have sips of tea/water, so you don't feel you have to fill in the pauses. And if you don’t know the answer to a question just say so. Do have a list with all questions ‘you’ want to ask. Can last anything from half an hour to an hour and a half.

    So we're nearly there, I'm just triple checking our forms and I've been to the bank today to withdraw what little cash we have so we can pay our immediate bills after we do the deed on Friday.

    I'm feeling a little nervous but know that after Friday we can tell all the creditors hounding us with phone calls to bog off.

    Also what did you do about childcare, when you went to court? Unfortunately I can't get any for Friday so will have to take 19m DD with us and we'll just have to tag team her whilst each of us see's the judge and OR.

    I have my fingers crossed for you on Friday and if you are worried, do ring the court explaining your childcare situation.
