    CB #2 of 5 update....

    TMO seem to be having an internal comms problem between forum queries, customer service and cb team based on the e-mails I've had back regarding cb#2. However, my claim has been logged and successful, so BACS payment SHOULD be with me by late next week.

    Further updates as and when available.....

    p.s. what happened to my last post ?? I note that at least 2 posts have been deleted off here. Any board guide care to comment ?? thanks.

    From what I saw of it before it was removed (in isolation), I imagine it was deleted because it was likely to provoke exactly the type of off-topic response that it was deprecating.

    It would be best to now get back to the topic of the thread instead of debating that.

    It’s 47 days since TMO received your claim,and 19 days since you should have received payment; have you received your cashback yet and, if not, what are you doing about extracting it from TMO?

    Shelby - thanks for taking it in the spirit it was intended.

    cb #2 of 5 for me:- day 29 was 8 June, I got confirmation of acceptence and notification of payment via BACS in 7-10 days on 11 June (Friday 8th and Monday 11th). Taking it as 10 working days, I should be due by tomorrow Friday 22nd. So, I'm on day 43 today.

    The problem is, with postings popping up and then disappearing all the time, replying to them is like trying to shoot rabbits!

    You seem to be on roughly on the same schedule with TMO as Brenda, but a couple of weeks behind her.

    If you want to do what she did and cover your position, you’d need to send TMO a Letter Before Action today or tomorrow - if your cashback hasn’t arrived - so they get it on Monday, 25 June (your Day 46; namely 18 days after your cashback was due).

    If you give them two weeks (ten working days) to pay you - by which I mean that you receive the money by then - your notice would then expire at close of play on Friday, 6 July. That would be your Day 57 and you would by then be preparing to send in your Claim 3.

    I suppose it all depends upon whether you want to hunt down each cashback as it falls due, the way she does, or whether (with only three months remaining until your contract can be terminated) you’re prepared to let them ride and then use the courts, if necessary, to collect whatever’s owing at the end.

    After your experience with Just3, you’re probably concerned to collect each instalment as soon as possible rather than risk losing several if the company goes the way Just3 did before you have extracted what’s owed to you!

    Can someone help me out here please? I'm probably being obtuse here, but how do I find out my customer number with TMO...I cant see any reference to a customer number on any docs except on the dispatch note which seems to be a different format than the 5 digit number that others are quoting.
    Any help greatly appreciated

    Does anyone happen to know the procedure for number ports and cashback? My partner has transferred her old number onto her new contract so will TMO want to see proof of this? I couldn't see anything in the T&C's about it but I know some of the other cashback companies ask for proof of transfer before honouring cashback claims.

    Giving 2 weeks to pay is overly generous - 3 days is sufficient, maybe 7 at the most - if you are really intending to chase via the scc.

    And once you've decided to take this route, then claim the total outstanding on the contract, not just the latest instalment.

    Do this by putting in your LBA and claim that their breach is a "fundamental" one.
  • TMO dilemma...

    Hi all, I'm a new one to air a problem with a mobileoutlet claim.
    I sent my claim in on time by recorded delivery and photocopied all the documents so in theory all sorted.

    After 28 days I recieved a letter stating that my claim was refused as I did not include the despatch note, except I did. I even still have a photocopy of it.

    So I emailed and pointed that out and recieved a reply asking me to send the photocopy, so I copied it again and sent that off. I then heard nothing for ages. So I enquired again and was asked to fax my despatch note to them. So I did that on Monday.

    Today I recieved a letter stating I could not claim as I'm outside the 21 day claim period!!!

    I called the customer service line who were not helpful. They won't discuss cashback claims and told me to write in, however I pointed out that whenever I write in I get asked for more information which I supply only to be told it's invalid. I argued the point until I was promised a call back today from the cashback dept.

    I have to assume the call wont come so what now?

    I'm wondering if I should send a "Letter before Action" however the customer service dept told me that although I have copies of the documents AND proof of delivery I cannot prove what was actually delivered. It occurs to me the only way I could do that would be to have delivered by hand and got receipts for what was actually delivered, or have legal witnesses of what was posted?

    In essence, what on earth do I do now? I believe I'm in the right since I followed the T&C's in a timely manner but stand to lose my whole eligibility for the year (worth £360).

    If that’s the only document on which TMO has ever quoted you a Customer Number, then use it - no matter how the digits are formatted. It is, after all, their document and it was they who sent it to you!

    A number of points arise from this and I’ll leave you in the good hands of Quentin to deal with them because I’m just about to go abroad for a month.

    Here are some things for you and everyone else to ponder.

    1. If TMO is resorting to this sort of tactic it must be getting very desperate.

    2. TMO cannot know, unless you tell them (so don’t, on here!) whether or not you can prove what was inside the package you sent them. If you can, what they have done is very dangerous - and they know it. They are taking a big risk.

    3. To deny you your cashback if you have submitted a valid claim is a matter you need to challenge and pursue through the civil courts (to get your money). But to lie about what they received from you would be a criminal offence because to do so is fraudulent - it is to obtain money by deception. You should seek advice from your Local Trading Standards Office immediately.

    4. In view of the sums of money involved, it is always advisable to take some precautions before sending off the claim and this should include having credible proof of what was contained in the package you sent off. I did and I know (from messages received) that several people posting currently on here (including Brenda) do so, too.

    Brenda posted on here that the front page had been removed from one of the invoices TMO returned to her in the SAE she included. No reason was ever given for this but if TMO had been tempted to allege that she had submitted an incomplete invoice they were extremely wise not to do so and to pay her her cashback (late though they did) because she had proof of what was in her claim submission and if it had gone to court TMO would have found itself in serious trouble. A judge in a civil case can refer the papers to the Crown Prosecution Service.

    Still, I am sure this is just hypothetical and was simply an honest mistake by TMO with no criminal intent whatsoever. :D

    If it were me, I'd write a letter stating what has happened and that if I didn't get my money in two weeks (seems reasonable to me), then I would be going to the small claims court, I'd send it recorded delivery.

    I'd also email a copy to TMO.
