I had to chase up Bott & Co as I'd heard nothing from them in over 2 months. Got a prompt reply which seems to say ' we might do something sometime in the future'
"The airline has previously denied any liability to compensate the passengers on this flight. We are not yet in a position to issue court proceedings on this claim, however we will continue to review the matter every 28 days. We will continue to update you as and when further developments occur."

Sorry to hear things aren't going well with your claim Kuepper.
Ive just had an email saying Bott received confirmation from the Court that formal Court Proceedings have been issued and served on the airline. They are obliged to acknowledge receipt of those Proceedings within 14 days and then provide a formal written Defence within a further 14 days.
Will be interesting to see what their defence is as they told me nothing specific just technical issues and exceptional circs and as of yet have failed to respond to Bott. I wonder if their failing to respond and not giving an explanation is why Bott have issued court papers in my case?0 -
Just as with Liberty, I too have had confirmation that proceedings have now been served on British Airways.
I was simply told it was an
"Air traffic issue" with no further details, this particular flight tends to depart between 30
And 50 minutes late every day so it'll be interesting to hear a full explanation.0 -

In response to my initial letter they stated:
[FONT=Arial, sans-serif]"I can confirm the root cause of your delay was an unexpected technical fault to the aircraft scheduled to operate your flight. As a direct result this caused the delay to your flight. This was an extraordinary circumstance which could not have been foreseen, and which was beyond Jet2.com's actual control."[/FONT]
Whilst in a letter given to us while boarding at Funchal they had stated:
[FONT="] “The delay is due to a previous late running service that was affected by an earlier operational problem with the aircraft.” [/FONT]
Yet on board we were told it was because the staff originally assigned to the flight had exceeded their hours, so the staff we actually had had been summoned from their homes by phone about an hour after the flight should have taken off from Manchester!.0 -
