Can't cope in this house...please help!

Hi All,

I having been in a rental property for 18 months. I recently had another baby and I can't cope here any more.

One of the neighbours came by to say that there was mice in the attics. Poison has been put down but I can't cope with the thought that there could be mice now down in the house. I can't let my newborn lay on the floor as I am terrified that a mouse may go near here. There is no evidence that any mice have gotten down into the flat but we have heard rustling. It's not just in my mind, my 5yr old knows nothing of the mice and she said that she heard funny rustling in her room.

I really feel like I need to just leave the property and take my kids to live with family until I can sort somewhere else out. I am concerned that it is causing some sort of anxiety for me as my chest feels tight constantly and it is on my mind all the time. I can't sleep as I am scared that my kids are sharing a house with mice and I am crying all the time as I just feel so trapped in this house.

Can I just leave? What will happen if I do?

    I think you need to get a ruddy grip! Mice will be more afraid of you than you are of them. If you haven't seen any mice or any mouse-droppings then they might be in the attic but not in the rest of the property.

    Of course you can leave. But that does not mean you won't have to pay the rent.

    As you have been in the property for 18 months does this mean you have signed a fixed-term AST? When and for how long?

    I have only had one 6 month lease which was signed when I moved in. I was sent another one but never got round to signing and sending it back. Landlord doesn't really talk to me much and I haven't had any of the usual annual safety checks etc.

    What do you think the mice are going to do to you?

    This seems a massive over-reaction to the problem. Is this the final straw in a series of problems that are stressing you?

    not even a boiler check?! Tell the landlord to put mice on the inventory or you'll report him to HSE and Gas Safe!

    What kindof contract do you have? Is it a fixed term, in which case what was the start date and when is the end date?

    Or is it Periodic (monthly, rolling)? In which case you can give about a months notice (for precide dates, read the link below).

    Ending/Renewing an AST (what happens when the Fixed Term ends?)(What is a Periodic Tenancy?)(How can a LL remove a tenant?)(How can a tenant end a tenancy?)

    But honestly!Mice? No big deal.

    * Poison in attic will kill them.

    * buy a couple of traps and put in kitchen (they will only be interested in food, NOT your baby). These work well with peanut butter.


    * keep house clean. No food lying around = no mice

    I'd be more worried about the boiler. WRITE to landlord and ask for gas safety certificate. Much more of an issue.

    I'm sure they are in the property...we have definitely heard them. I have three children under 5 and literally every time they call me with any kind of urgency, I think it's because they have saw a mouse and my heart races! :'( My daughter is only 3 weeks old...I can't live like this anymore :(

    Think your boiler should be more of a concern, explosion, leaking gas
    Don't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.

    No checks at all. My washing machine broke down and she said that they were suffering financial problems and I had to source a second hand one. I have had zero checks since I moved into the property and I don't think my deposit has been protected anywhere. I live in Scotland if it helps.

    I have an assured shorthold tenancy, last signed on the date I moved in 18 months ago x
