But it depends if FionaCat ever appealed as such.

Telling them to get stuffed ought to suffice. Who the hell are they to decide what is or is not a challenge? Trying time and time again with different forms of words eventually comes to look as though you are begging them for a PoPLA code and confers on them a legitimacy and authority to which they are not entitled. You have to stop sooner rather than later and instead start attacking their legitimacy through DVLA, BPA, TS and every other route you can think of.

Yep I know, but 'play the game' and you get a POPLA code and then beat them at their expense. Got to be the plan, hence why we are saying that the first challenge needs an appeal point in it such as signage (always a good one) or no loss (almost always the case).
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hi guys - I challenged twice, following the advice given to me in this thread.

First time I said - give my a Popla code cause I don't acknowledge you, and you have to give me the code.

Second time I followed wording on this thread saying roughly
    "Dear sirs,

My appeal point is that I do not recognise your authority in this car park or to offer any contracts to parking motorists.

Either accept that challenge or provide the POPLA code. Failure to do either will involve a complaint to the BPA complaining about your failure to adhere to their COP or POFA 2012.

It's make your mind up time and the clock is ticking.

    Yours faithfully

Which was posted on the first page of this thread.

    What have I done wrong????

Absolutely nothing, that is a very valid appeal point. If they refuse to recognise it as one then complain like hell as I said to the bpa, dvla and popla. The reason by the way I suspect they don't want to give you the code is that alone is a winning popla appeal, and they know it. They want you to go away and not cost them £27+vat

    Cool. Thanks!!

Do you know how to start complaints to these people?
Will it make the letters stop?

We'll have to agree to disagree. These people are scum and should be neither grovelled to nor allowed to make up their own rules.

    DVLA: FOI@dvla.gsi.gov.uk

    BPA: http://www.britishparking.co.uk/Feedback-on-a-BPA-member

Trading Standards: contact your county council for their address. You'll need to write to them, if you call the number they give you you'll get nowhere.

With DVLA and BPA you are majoring on Highview breaching the BPA Code of Practice by refusing to supply a PoPLA code. With TS, your angle is offences under the Consumer Protection From Unfair Trading Regulations 2008 (such as Highview failing to comply with a code of conduct to which they have committed).

Also write to your MP. He/she can't influence Highview, but can and should take an interest in the DVLA supplying personal data to cowboy companies like Highview: http://www.parliament.uk/mps-lords-and-offices/mps/

Tell the BPA that you have also complained to DVLA. Tell DVLA and Trading Standards that you have also complained to your MP.

Can't guarantee any of this will make the letters stop, but nothing else is working is it?

Thanks :) really loving the help guys :)

I'll do that and complain. Really annoying they can just send me nasty letters asking for money and not sticking to the code lines.

Not sure when your parking was but version 2 is for ones before June 20th, version 3 after. Have a look at see what other breaches they are doing

Here is version 2 of the code of practice > June 19th

  • Hi FionaCat,

I am currently in the same situation as you, playing parking poker with CP Plus whose appeals are run out of the same address as Highview (I think they are run by Ranger services). Despite me begging them to give me a popla code before their 35 day deadline ran out, they refused. For the regulars who know me, this appeal was quite straightforward and without jokes as I specifically wanted to test out a point in POFA 2012.

I have done as Bazster suggests and complained to the BPA Ltd in the first instance. Please do the same as it is only if people complain that the rogue operators get weeded out and we are left with...uh...well I'm not sure who would be left to be honest!

I will blog about CP Plus about some point but please keep us up to date as to how your complaint with the BPA Ltd goes. http://www.britishparking.co.uk/AOS-Sanctions shows that failure to give motorist the arrangements for popla is a 5 point offence.
