Highview Parking aren't giving me a POPLA code

And another thought: FionaCat, was this a Tesco car park? If so, I would copy all the correspondence to Tesco at their registered address, with a covering letter:
Sirs
Please see the attached correspondence which is self-explanatory. Your agent, Highview Parking, is blatantly flouting the BPA Code of Practice by refusing to issue me with a PoPLA code so I may appeal the issue of a charge notice to the independent adjudicator.
Highview's actions are a violation of the Consumer Protection from Unfair Trading Regulations 2008. Furthermore, I have now put Highview on notice that any further demands from them will be regarded as harassment.
I would remind you that you are legally liable for the actions of your agent, so I strongly recommend that, in your own interests, you reign them in and require them to comply with their obligations.Je suis Charlie.0 -
My opinion is that a totally wet appeal to the PPC making no legal points, drivelling on about the circumstances and pleading mitigation is more likely to get a PoPLA code first time i.e. the sort of appeal someone might write if they'd never received any advice.
- I didn't see the signs
- I was only 10 miniutes late becuase of the queues in the shop
- My disabled badge/P&D ticket fell off
- 1 was only 2mm over the line
and may more. If POPLA is the ultimate aim, then choose this route. The alternative route is to do an immediate hard appeal in the hope of getting it cancelled there and then. But as we know, the PPCs will never accept an appeal, no matter how robust, and it just leads to the ridiculous situation Highview have got themselves into.0 -
The problem I see with this is that using mitigation normally means you admit you were the driver of the vehicle, something that you shouldn't do at any stage. I think that complaints should be given in tandem to rejections, if there is no popla code on then complaints to the dvla, bpa, popla and maybe trading standards as well.
We need to ensure that we are doing that and making sure that we are getting OPs are doing their bit to get hundreds of complaints to these organisations.When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

There is certainly some sense in using a weak appeal to get the POPLA code as suggested above.
Only disadvantage I can see is if it ever got to court, then you would need to be careful which weak point had been used initially as all paperwork could be referred to.0 -

The majority of members of the BPA Ltd are actually councils. I suspect that the antics of the quasi-criminal end of PPC World populated as it is by knuckle dragging ex-clampers is a big embarrassment to them.
If that's the case shouldn't we all be demanding that our local councils withdraw to save money due to the current cuts ?0
