Let's see the BPA's useless response, it will be enlightening! :)

Fiona Cat we have been ignoring these fake PCNs for many years and nothing has changed except that POPLA cancels them rather than you having to receive some debt collector letters. You have just been unfairly & stupidly denied POPLA, that's all, so you are back to square one and NO-ONE here pays these scam fake PCNs!!!!!!!!!!!

Highview do not do Court. We are talking junk mail - and I have ignored 2 fake PCNs myself. We do know what we are talking about!

All respect guys, but I followed your advice once, then I was told I was wrong.

What am I supposed to do now ?

I am beginning to think that you may be a PPC stooge wasting our time. The BPA as said are the trade association of the Parking Industry. So if they say you are wrong, that is to be expected.

You keep coming back time and time again despite being told what to do and I don't think we can help you further. Thankfully the forum is going down soon so this thread will get some rest.

FC - why don't you read further around the forum, especially the POPLA Decisions sticky.

Do you think any of us would waste so much of our own time dishing out junk information?

Just look at the cases we've helped win for dozens of worried and pressurised individuals.

If you put more faith in the BPA than us, then OK, get on with it, sign the cheque and get it in the post tomorrow.

But if you want a better than even chance of winning this, you might want to re-evaluate your thinking.

Don't forget, it's your ticket, your problem, our time is stretched, we want to expend that on people who want to work with us.

As they say in Thailand - 'Up to you' :).

You seem to be getting a bit angry with me - sorry :(

I have followed all of your advice with the letters to Highview. Then followed your advice to write to British parking. If they are not helpful then why ask me to write to them?

I'm still not getting anywhere :( I don't have a Popla code, and the letters keep coming :(

It's not that I don't trust you guys, just that things aren't working :(

Sorry if I'm being annoying :(

    PS parking people said -
    Dear [me]

    Thank you for your e-mail.

    BPA – [code] - [code]

Please be advised that before you can appeal to POPLA you must appeal to the operator directly. Having looked at the appeal you submitted, the operator is correct in their reply. This is not a valid appeal.

We would suggest you to appeal further to the operator outlining the reasons why you are disputing the charge.

    Kind regards,

    AOS Investigations Team

The only anger we have is towards PPCs, never the motorist asking for help. Frustration - now that's an entirely different matter!

We'll help as much as we can, but you need to work with us. We won't feed you any carp lines, but just those that have worked many times before.

Stay with the script and we'll help you. We (you) need to get that POPLA code, and you need to do whatever is necessary to get that. Then we're on the way to getting to the meat of the situation and helping you knock your problem on the head. No guarantees (you can go it alone if you feel you have better options), but we will give you as much (informed) help as you'll get from anywhere.

    Up to you.

    Ok - great - thanks :)

But I'm still confused on what my next step is.

Should I write again to Highview with a more easy appeal?
There are no signs on the way into or out of the car park.

Should I say that ? Then get them to reject it?

Please can you show us what the BPA said in the letter or email?

You will be ignoring Highview now like in the good old days before POPLA. No POPLA? IGNORE.

Well you ignore them, what part of highview don't do court you don't understand ? There is no guarantee that won't change at some point, but to date they have never been there.

And the letter to the bpa is a complaint to a trade body of the parking companies, there is nothing in the bpa Code of Practice that covers only certain appeals are acceptable, read it for yourself

    http://www.britishparking.co.uk/write/Documents/AOS/12_AOS_CoP_June_2013_update.pdf

There is nothing in the Protection of Freedoms Act 2012 covering this

    http://www.legislation.gov.uk/ukpga/2012/9/schedule/4/enacted

So frankly they would insane to take you to court, you have proof that you have tried your best to do the right thing, they are acting unlawfully by not allowing your legal right to appeal.

We are not here to waste our time, and we are not here with a vested financial interest in you paying, the bpa has an interest as highview and other parking companies fully fund them.
When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.
