Why does the NRP need to see my accounts?

    She's emailed back and has sent a letter to the court, saying I'm 'refusing' to send the rest of the information. I called the Remo unit in London (I'm still surprised I managed to get through!), they said all I needed to provide were balances, not statements, so they have all they need. I've emailed the solicitor to say that I'm 'unwilling to participate in his time wasting, bullying exercises' and that I'm happy to supply any additional documentation to the court should they ask for them. It's not making me look good if she's emailing the court and telling them this though.

    I'm puzzled by this??? If it's your ex that is the NRP, why do they need details of your accounts? Surely it's his they need details of, as he is the one who owes? I've never heard of PWC's having to provide financial details before. My daughter certainly didn't when she was chasing her ex for maintenance, or is it a REMO "thing"?

    I'm in the process of obtaining a REMO order as the ex decided he didn't want to pay maintenance any more. I filled the form in, took along the documents (bank statements/statement of end of year accounts that the tax office has/birth certificate). For some reason the ex has decided to spend money on a solicitor and they have asked for a few extra days to get their financial statements in order and has said I should go through her (which is fine as he's been blanking me for over a year).

    I've received an email from his solicitor this evening asking for more bank statements from me and my accounts (I'm self employed). I wasn't aware that he would see my finances as it has nothing to do with whether he should pay maintenance and how much he should pay. Are the courts supposed to give him access to my finances? Seems as though I've done something wrong here, not him.

    I am going through R E M O at the moment

    You do have to prove to the 'Courts' only, proof of all your income.

    They pass it to the other country in question and ask NRP for their proof of all income.

    You will get a copy of his and he will get a copy of yours (Just like they do on CSA1 and Tribunals).

    As you say the courts' here don't seem to have a clue as many of us have been through. My order was made 6 months and 10 days ago but the Judge would NOT believe my CSA assessment was for £150.00pw, even though it was sitting in black and white in front of her.

    All I have been told over and over (when I've had to chase and pester the court' here:)) is - "We're waiting for a response from the authorities in that country"! Unconcerned but very sympathetic.

    In the meantime I have also been contacting the authorities direct since month 2 and on the 7th June I have received an email from the FRO office that they HAVE received my order and it will be processed within 90 days - Result!

    I immediately contacted my court and they were very 'miffed' at me doing there job (it's the court enforcement office actually).

    So my advice would be - do not deal with his or any solicitor, she should be dealing with the courts direct - if he insists on having one and is simply trying it on with you' and to contact, pester, write and call Ireland authorities until you get a reply that they have received your order for child maintenance, which they must have if NRP is asking for more details.

    He wants to know about all your income so he can try going down the 'Hardship' route where NRP can ask for a reduction!

    Hardship? Hahaha! Our son is disabled. I pay for a school for him as it's the best one which meets his needs (he's not severe enough for a statement, not able to go to a state school for lots of reasons). His father has never contributed towards this, despite knowing that it causes me great hardship.

    I emailed the court last night to confirm the documents they needed. She called me back this morning and, basically, she hasn't sent ANY of my finances to the court in Ireland or to the high court in the UK so there's no way that my ex or his solicitor would have any of them.

    The lady in the court said now that they have asked for them they need to be sent. She asked about my 'refusal' to hand over my finances, and said it would mean the court would have to postpone the hearing if I didn't provide them I explained that I did not refuse and had already given the court all I had and am happy to hand over more if the court needs them.

    She twigged that the solicitor doesn't know what she's doing and has set a date for the hearing which will be at the end of July! She's also going to contact the solicitor and send copies of the information I've supplied them (but I get to see his too) and has said I shouldn't provide any more as these are ample. I asked her about trying to get help with the school fees (why not?), she said bring confirmation of the amount I pay to the hearing.

    I've not heard from the solicitor today, strangely enough.

    We're trying to think of a way to spend his money in a way which is going to really, really annoy him (providing we get any that is). Holiday? Large TV? live off take aways for a month? Na, we'll pay the bills and be happy. That's the best thing that we can do to make him feel bad I recon.

    I've had an email from his solicitor saying he wants to settle as he doesn't want to go to court. I'm assuming they have realised how much they will have to pay now they have seen my expenses and this is a damage limitation exercise. I've asked for the outstanding arrears before I'll even consider it and have said that I will be seeking a contribution towards our son's school fees on top of any maintenance. I've no idea what his earnings are but my friend google estimates them at 35,000 euros. He has 2 other children now so should I be aiming for £6k, so start at 10K and let them think they are getting a bargain? :D

You need these before you consider anything. I've no idea what his earnings are but my friend google estimates them at 35,000 euros.     Take a few deep breaths and don't do anything for the moment. I would also be phoning Remo back and asking their advice....generally... in these circumstances...note the word...general.

    Sure the other peeps with Remo experience will be along shortly, but I was always told NEVER to accept the first out of court settlement figure.

    5 minutes ago this solicitor was beating you up and now he wants a cosy chat?!! Talking settlement when there are not even any figures on the table? These guys are unreal.

    You know I've been thinking further about this.

    You do need to show you have negotiated with the NRP before it goes to court so the court can see you tried your upmost to come to a sensible arrangement for the child.

    But...and especially as you are representing yourself...I would ultimately go to court.It would be even better if he fails to provide his financials. The judge won't look favourably on that.

    Sit tight and plan.

    Just my opinion.

    I'm not going to accept anything. I've said I'll consider a reasonable offer, doesn't mean I'll accept it though. I need to see all of his finances first and will request these when she gets back to me.

    I'm assuming they believe the court will eat him alive and screw him for everything he has (excellent!). I'm not out for revenge though, just an appropriate amount for my son so that I don't have to have a slice of toast for lunch because I feel guilty for eating any of the little food that we have.

    At least I know he's running scared. It's a game, isn't it?
